Need advice with IPDLs


Ok, I have posted a couple of times here and read a whole bunch of posts regarding my IPDLS. It's almost an obsession reading all of the posts lol. But at least I don't feel as stupid as I did in the beginning for getting into this mess.

I have 9 IPDLS. I retained Langhorne debt solutions last week and have already had them debit their first payment.

Here are my concerns, and hopefully some of you can tell me in your experiences, the best way to handle them.

The first one is that I closed my checking account last Thursday. I spoke to the branch manager and he told me if I closed my account, anything that tried to hit it would re open my account. He said there was no way around this. I called a couple of other branch managers at different locations as well as the 800 number and all of them tell me there is nothing they can do. One person did tell me if I had reported fraudulant activity before I closed it they would have freezed my account temporarily, would have been nice if someone told me that before I closed the account. SO I am expecting this account to go way into the negative. I already opened a new account so I am not worried about having an account, I am worried about getting into trouble for this account going into the negative. Do the banks typically give you any time to pay this back? And how long will the PDLS continue to hit my account? Will they still do so after they see the account is closed?

My other concern is these places calling my work after they realize I default. I really don't want my coworkers knowing my personal business and I can get into trouble if they start calling non-stop. Has anyone had any luck getting them to not call work? They can call my cell all day if they want.

I know Langhorne said they would handle these things, but they had to wait for my payment to clear before doing so. I feel there is going to be a lapse between when they get the payment cleared and when the IPDLS realize I defaulted.

Any advice would be extremely appreciated!


As far as the bank goes I would demand a "hard stop" on your closed account. If they say they are unable to do it I would document their policy (also ask to see it in their bank information) and make sure you get this branch manager to sign off that you have requested and been denied the ability to hard stop. That is ridiculous that they would hold you liable for NSF charges when you knowingly closed the account to prevent further ACH activity. In my opinion I would fight them tooth and nail on this one.

I sent emails and faxes to all my PDL's the day after they tried to hit my closed account. I revoked permission to ACH, retracted any garnishment of wages and specifically noted all communication was to be in the form of email or US mail. Some have called my home number but I only received one call at work and just told them I can't accept calls at my work number and hung up.

Good luck and keep us posted. Play tough with that bank of yours, they can do anything they want to as far as the conditions being put on your closed account. I would also insist they "freeze" the account due to fraudulent activity and remember any NSF's that do hit can be reversed by the bank so don't let them hold you hostage for more money when you gave them the particulars of how you wanted the account handled.

Shelly, just as another example to Mperez': My bank did nothing to help me either...I contacted the 2 branches that I visited and no one could tell me anything. My account ended up -1100. by the time the bank actually closed it for good. During that time I sent a letter explaining the whole situation and what I had learned about blocks,etc. to the main office of the bank, the loss prevention dept. and the managers of both branches I had gone to for help. About a month later I recieved a letter from the LP dept. asking me to call to discuss my overdraft situation. They did make payment arrangements...but you have to go with what they give you and I was told in order to keep them from listing me with Chexsystems I had to make regular payments and the balance had to be paid off in 12 months. I was also told after I made a few payments I should visit the manager of the branch I originally worked with, show them all my paper work and ask them to reduce the fee's. I was told LP could do nothing and it was up to the branch manager what could and would not be taken off.

Yeah, my bank did the same thing to me. After around 30 days of your account being negative the bank will freeze and close it. How nice!

Just be careful - If your new bank uses Chexsystems, and your old bank reports you, there is a chance that the new bank will do a sweep on new accounts and find your report. They then may freeze and close your new account.

Wow that really stinks! I guess I was more fortunate than I realized because my bank went out of there way to help me. I went in and asked to see a bank counselor and then told her my entire story including that I wanted to close my account but would like to hear from her what she recommended. When she started looking at my monthly statements on line she was floored by what had been going on for years. She assured me that my account would shutdown to everything and not be able to be reopened. She even called someone else to verify her statements. And in case for whatever reason something happened and I was hit with NSF's she gave me her business card and told me to call her and she would make sure they got reversed. She suggested I keep a $1 in one of the savings accounts I had because I then would be able to cash my paycheck without any holds put on it. She even went as far as to tell me to go to a completely different bank to open a new checking account. According to her the PDL's would have to be able to match my account number with a routing number in order to find that account. I know I've heard on this site of others having problems with being traced but so far so good.
I feel terrible for you guys - I'm just amazed that the banking industry can get away with that - it seems so inconsistent. Did you inquire with your state banking division to see if they could intervene?
Like I stated earlier I guess I was luckier than I realized. :oops:

Mpereze, that's how my bank was. The bank manager told me that my account was closed and nothing could go through or make it reopen and that if I had any problems with my new account at that same bank, let them know and they just wouldn't let it go through. There's a reason I've been with them since I was 4 (savings) and I keep getting little reminders like that. :) I can't believe that other banks aren't like that...I think they just want their little 32 dollar fees everytime something bounces. I had an account at Bank of America and that's how they were.

Yeah, I was told that nothing would reopen my account too. And then when that happened, I called the guy that had told me it wouldn't happen. At first he reversed the fees for me, but after 2 weeks of this happening (because he said he couldn't close or freeze it again until it was postive for at least a day) the loss prevention dept stepped in. They accused the branch manager of being in with me because he had reversed about 30 nsf fees in the 2 week period. They reinstated them all, and sent me to chexsystems for fraud! I disputed things for a few months, filed complaints, did all I could do without a lawyer, and finally gave up. I will never in my life bank at that bank again, obviously. I did everything I was told to do by the bank, and ended up being screwed royally.
