How to get out of debt with payday loans in Ohio


Hi

My name is Dj, I live in Ohio. I have taken out too many paydays loans now they are all hitting my account at once and I don't know what to do. I found myself in the situation where I was borrowing from one loan company to pay off another and my paycheck was not enough to cover them. I have been going through this for months now. I haven't been able to keep my paycheck in God knows how long and it was causing my other bills like my car note to get backed up.

Does anyone have any suggestions for me?

Hi, welcome to the forums. You have come to the right place. Please tell us how much each loan was for and from which lender. Also, how much you have paid each one so far and the State that you live in. That way we can help you determine what you legally owe.
You must close or freeze your checking account immediately so that you can breathe and deal with these companies on your terms, not theirs. Tell your payroll dept that you need to get a live a while. paycheck for

Welcome to the Community DJ :D Here is a link to PDL laws state by state, and for Ohio at http://www.paydayloaninfo.org/state_detail.cfm?id=OH You can see where yours fit into this. Are these internet or store front, and how much did you borrow and pay back? Look for that info, and look at the link and you will get some answers. Also, if you post the names of the companies, we may be able to give you some more info. Don't feel bad, all of us have gotten into a viscious cycle, but there is hope. I have gotten all of mine taken care of and also paid off credit cards since coming to this site. It takes time and effort, but it can be done! Hi,

Thanks for responding. I have been dealing with them since 2004 so there's no way for me to calculate how much I have spent with them but now the situation is that I finally got a decent enough raise to where I won't need to use them and I keep being forced to use them because I am borrowing from one to pay off another. This is what I have outstanding at this time:

Checksmart: $460 due on 8/1 (borrowed $400)
Express Payroll: $460.00 due on 7/29 (borrowed $400)
American Cash Exchange: $345 due on 8/1 (borrowed $300)
Advance America: $575 due on 8/1 (borrowed $500)
Check into Cash: $287.50 due on 8/7 (borrowed $250 - they gave me an ext until 8/7 it was actually do I think on 7/15)
American Payroll Adavance: $230 due on 8/9 (borrowed $200)

Cash 2 U Leasing: $688.75 or $151.25 for a 2 week ext - due on 8/17. I borrowed $500 from this place and had to put my computer, tv and dvd down as collateral. I signed a contract that says they own my property and will sell it back to me once this "cash lease" is paid off. I have to keep paying them $151.25 until I can afford to pay off the $688.75 and when I can't come up with the ext payment on time then I have to pay a $90 fee to give me additional time to make the ext payment of $151.25

None of these are internet loan companies. I know this really bad but do you know of anything I can do. I don't want to close my account because I need it for my paycheck. Would it be illegal for me to do a stop payment on the outstanding checks and then contact each loan company to set up payment arrang.

Well it doesn't say in the Ohio payday lender laws that it is illegal to default on the loan, but it also says the borrower can be charged collection and court costs if they decide to sue you. You could try discussing with them that you need to set up payment arrangements to get the loans paid off, just to feel them out and see what they tell you. Could you open a new account at a different bank and just have your wages deposited in the new account?

I know there are forum members from Ohio on here who have dealt with pdls, though I don't know how many of them were storefronts. Hopefully, a fellow Buckeye can help you out.

Thanks for the responses. Since I last logged on I have had the bank (checking acct) that I wrote the checks against, put my acct on deposit only until 8/17 when I will be able to bring my checking acct current. I have contacted several of the places I owe to make payment arragnments. 2 of the places are willing to work with me, but Checksmart and Express Payroll which are sister companies here in Ohio, keep calling me and are telling me that they can prosecute me for "passing bad checks." If I don't pay them their money by the end of the month. I've advised them that I can pay half of the money $460+$24.50 so $484.50 on Sept. 1st and the other half on Sept. 15th. They told me this not acceptable. Also, I have been dealing with these places since 2004 and have never updated my work information there, so they have me listed up under my old employer and when I talked to them today they asked me for my current employment information so they can send a letter to my boss. I told them no.

I am really scared. Can anyone tell me (a) if I can be prosecuted for writing bad checks for these payday loans and (b) if I can be prosecuted for fraud since I never updated my work information with these 2 places.

I am really close to getting myself out of this payday loan hell but these places are making it hard for me, any suggestions.

I am from Ohio and I had many payday loans out. I found a company to help me out with these. Now with CheckSmart and Express Payroll they are very hard to work with but they never turned me over for bad checks. They did find a fax number to my H.R. department and sent a work validation sheet to see if I was still employed and how much I make.

Checksmart and Express are members of CFSA and this is from the CFSA rules.

They should allow you to make payments to them, this is taken from CFSA website. They should not even threaten you for bad checks either. If you know the names, you can go to CFSA website and file a compliant.

Thanks so much for the info Ryan and Tiffany. I also received a call yesterday from a rep with the Capital Law Group, giving me suggestions on how to get myself out of this trouble. Thank you all so much. I am SO glad I found this site. I will keep you all posted on my progress.
