Too many payday loans: How to come out of it?
Welcome to the Community anna :D Don't feel as if you are alone
Welcome to the Community anna :D Don't feel as if you are alone! Many of us got caught up in the trap of pdls because of too many payday loans. Can you tell us what state you are in, the companies names, how much the loan was for and what you have paid? The reason I am asking is, in most states, the internet pay day loans are illegal, and operate illegally. We can direct you in the right direction with a lieelt more info-no personal info please-Keep us posted..Karen

anna, just by glancing, I see you are in PA. From what I understand, PA has some kind of funky "loophole" regarding internet pdl's. However, I can tell you that two, right off the bat, are illegal. But also just by glancing, I see you haven't paid the principle on any of them. Am I correct in seeing this? Do not worry. You are in the right place and everyone can help you here. I'm not a PA expert. I just know there's something funky about PA and internet lending. But we do need to see which of your pdl's are licensed and/or legal. Like I said, just by glancing, two are not. We can help you with this. Don't feel alone. Someone with PA knowledge can tell you more, but I can also at least look up who's licensed and try to help some more. You already closed your bank account?

Yes, I already closed my account. However, I was worried until I found this web-site and realized I am not alone and there is a way out. I have know idea how to start putting a dent in this whole mess. How do I find out who is and who is not legal? Thanks for all the help And yes I included the intersted not knowing. sorry
anna
Okay, they're all internet loans and you are in PA. You've already closed your bank account. Okay. Now go back and for each one of the pdl's list only what the borrowed amount was (what actually was deposited into your account) and then what you've paid on them so far. We can find your state law (PA is kind of funky) and also we can check to see if these pdl's are licensed. Please post the borrowed amount only for each one though. Thanks! :D

Yeah, in PA there is a bit of a disagreement going on between the Banking Dept that regulates these companies, and the Attorney General's office. One says internet companies are legal as long as they are licensed in their home state, and the other seems to say they aren't.
I would make sure to file complaints against these companies and see what kind of response you get. I know it has gone both ways . . . .
Also, did you end up owing money to the bank? Are you reported to Chexsystems?

This is what was deposited in to my account from each pdl company.....
CASHNETUSA - 800.00 - paid = $360.00
CASH CENTRAL - 300.00 - PAID = $150.00
ONECLICK CASH - 300.00 - PAID $180.00
NET CASH USA - 300.00 - PAID $90.00
UNITED CASH - 350.00 - paid $105.00
Crown lending - 250.00 - paid $0
Sorry about the miss understanding, however, no I am not in check systems because I closed out my checking account before they could hit it again. I also opened up a new checking account with a diffrent bank and NO ONE IS GETTING THE CHECKING ACCOUNT NUMBER except my regular bills.... I just want to do the right thing a pay these people. So, do I pay in payments or do I pay one pdl company at a time... I can't want until I have this under control... Thanks again.

It's really up to you how you want to pay them. I think it may be better to pay a bit to each company every month. At least that way you won't have as terrible calls from them.
anna
anna, I checked for PA licenses and didn't see any for the pdl's that you have. Someone may, please, go behind me and double check, just to be on the positive side. However, goudah, does anna need to check the state where the pdl is located to see if they are licensed in their state? PA laws are confusing. Obviously PA prohibits pay day lending. However, if there is some funky "loophole" regarding internet pay day lending, we need to cover all our angles. So, if goudah could let us know if you need to check the state the pdl is actually in, we'll know more. I can tell you right off that One Click Cash and United Cash Loans (that is the correct pdl, right?) are not licensed. I'm wondering if it's safe to assume since pay day lending is prohibited in your state, that you would only have to pay the principle? Someone help me on that one? If that's the case, you would have:
CashNetUSA owe $440.00
Cash Central owe $150.00
One Click Cash owe $120.00
Net Cash owe $210.00
United Cash Loans owe $245.00
Crown Lending owe $250.00
Here is your PA state law regarding pdl's:
Legal Status: Prohibited
Citation:
Check cashers are specifically prohibited from making payday loans under Check Cashing Licensing Act of 1998, ???? 505(a). Otherwise, consumer discount company act applies. 7 Pa. Cons. Stat. Ann. ???? 6201 et seq.
Small Loan Rate Cap
$9.50 per $100 per year discount or 24% per year

Now if someone can come along and has knowledge of PA internet lending, that would be great. I'm certainly no expert. Just trying to help as much as I can up to this point!

The banking dept says that the company has to be licensed in another state to lend legally, so yes, you would have to check into other states to see if they have a license. PA does not license these companies.
But the AG's office does say different . . . . It's kinda messed up.
But as far as the licensing issue goes - No, you won't find any licenses in PA. They do not give them out. If you go by what the banking dept (the ones that regulate these businesses) says, then you would have to find out what state these places are licensed in, if any, to see if they are legal or not and what they can charge.

FYI - The reasoning behind the banking depts interpretation is that the laws of PA all say "In this commonwealth". Meaning only applying to businesses located in PA.

Okay, you got goudah's response. You will need to see where each of these pdl's are located and check in their state to see if they are licensed to do business. Check your documents for addresses. Like I told you, I already know two of them are not licensed even in their own state. But you now need to check and see if the others are licensed in their own state.
THANK YOU GOUDAH!

No problem - But you also should keep in mind that the AG's office does at times say something different. One of the users here, Tukkitrocks, has had some favorable responses from the AG in PA too, so please be sure to at least file complaints against these companies. You may get some help from them, but it seems to be really hit or miss.

Thanks guys for all your help... I am aware of AG complaints and the fdcpa because I worked in 3rd party collections for about 5 years, however, I was not sure if any of that applyed to PDL.. Also, isn't the AG going to say something about taking out to many loans or it does not matter? Thanks again I feel the stress leaving slowly lol

Can anyone please tell me where these pdl company are located. I can not find oneclickcash. Because some of these pdl companys are not legal then I half way there if I do not have to pay the interest...Thanks

One way I find them is to check on the BBB site...if you do a search there it will show the address on record. However..another glitch...alot of these pdls have multiple names and address which make iharder. You can also do a search on this site in the google bar...sometimes you will find someone else here dealing with them and contact info in their thread.
anna
anna, do not be afraid to file the complaints. I swear, I thought the FBI was going to do an investigation on me because I had so many pdl's! LOL! I had 12 internet pdl's when I started. But, I'll be damned if I didn't file complaints on each and every one of them. You need to file with the state AG on them all, you need to file with the BBB on them all, you need to file with the FTC on them all. Do not be worried. Please file! As far as One Click Cash is concerned - welcome to my world! One Click Cash is actually MTE Financial. MTE Financial is horrible, horrible, horrible. They have over 18 d/b/a's and over 8 addresses. They lie to the government agencies. They will try to confuse you. They are my nightmare. One Click Cash is not licensed. I do have an address which I received when they responded to the BBB. However, please remember, they are MTE Financial. Here is the information I have for One Click Cash (and it came straight from them to the BBB).
One Click Cash

phone: 1-800-349-9418
fax: 1-800-491-6913
email: compliancedepartment(at)oneclickcash.com
Like I said, though, they are MTE Financial. Here is their information:
MTE Financial

One Click Cash will claim they are not MTE. MTE will claim they are not One Click Cash. Yes, they are one in the same. It's a little game they like to play. If you're going to file complaints on One Click Cash, you need to file a complaint on MTE Financial also. Do them separately.

Okay, i did it.. I filed a ag complainted both with oneclick and mte financial...i explained that they are not legal in both states.. I also filed them seperate... What happend now... I just pay the principal of what i owe if these pdl company's are not legal? Thanks so much... Got the ball rolling....
anna
Okay, anna. Good job so far. Did you also file with the BBB and the FTC? Do not leave them out. They are important. Some people get their pdl's resolved just through the BBB alone. Some people get responses from the FTC. Some people get responses from the state AG. You need to file with them all. They do pay attention. They review every complaint received. Refresh my memory (it's late!) did you already take care of your bank account? So the pdl's can not get any more money out of you?
anna
anna, I just read through all the posts to refresh myself. United Cash Loans is also an MTE Financial d/b/a. You can file complaints on them also, as they are not licensed to do business in their own state. Have you checked to see if the other pdl's are licensed in their own state to do business? CashNetUSA, it seems to be, might be licensed to do business in their state. This is if I'm thinking correctly. Do you have any documents showing the addresses of these pdl's and what state they are in? We can check to see if they are licensed in their own state. If they are not, you should only be obligated to pay the principle amount that you borrowed. Which means (after what you already paid):
CashNetUSA $440
Cash Central $150
One Click Cash $120
NetCashUSA $ 210
United Cash Loans $245
Crown Lending $250
However, we need to check and see if they are licensed in their own state, since PA has confusing internet lending laws. Did you happen to check yourself and see if they are licensed in their own state?

I can not find a address for United Cash or Net Cash, however, I will finish filing the complaints tomorrow. This is alot of work, bout it will worth it. I will do more research tomorrow.. ok..your bank account is safe, and you've filed all your complaints. I believe you said you were going to pay just the priciple balance on each that you owe. You won't have address for all of them...so if you have sent cease and desist letters you could email them asking for a place to send your payments..they will probably give you a hard time about this as many of them refuse to give out a mailing address, insisting instead that you send the money by money gram or western union. Some people take their time and pay one at a time off...others have sent small amounts to each one..

okay,i still need to file a complaint with cash net, crown lending, net cash , and cash central, however, i fornd an address for united and oneclick, and crown lending with the bbb. so how do i just pay the priciple on these loan, is it just because there not licensed ot is it because they do not following any banking laws or both. i am a little confused.

I also filed the ag complaints in their states not pa. This is all confusing. I should of never bothered with these pdl's however, i will not get discouraged because i ma half way there.
anna
anna, do not get discouraged. Please. It is work to get this taken care of on your own, but worth it. Yes, United Cash Loans and One Click Cash are both d/b/a's of MTE Financial. You filed with the BBB on them. Okay. You need to file with the BBB on all of your pdl's. You need to file with the FTC on all of your pdl's. You need to file with the state AG on all of the pdl's. File with your state AG. I don't know if you said you did or didn't. But your state AG still needs complaints filed against these companies. And, yes, United and One Click have unsatisfactory ratings on the BBB. Because people file complaints. That's why you have to do this for every one of them. You'll find all your pdl's will have unsatisfactory ratings with the BBB. People are complaining. The reason you're paying the principle amount of the loan is because that's what you borrowed. They provided the funds for you of say, $300, so pay the $300. That's what they gave you and you used. The reason people are fighting pdl's is because they are charging outrageous illegal "fees" and giving "extensions" and debiting bank accounts for more than they should for longer than they should. Do not get discouraged. Please. You need to get the addresses of your remaining pdl's and file the complaints.
I will not get discouraged, it is just frustating. However, I fo
I will not get discouraged, it is just frustating. However, I found an address for the rest of the pdl companies under the BBB. I will continue to file against the rest of them. Thanks for the encouragement. I will give you an update soon.
anna
anna, keep it up! It is frustrating! I think I was in my "own zone" for about a month while trying to send pdl letters, file complaints, fight with them on email, but then it calmed down once the complaints went in. Hang tough. You're doing good. And keep us posted! If you need anything, just ask! :D

okay, I will keep you posted. The complaints should kick in the next week or two, I think.... I will stay strong and just keep filing the complaints.... Talk to later... Oh, do I let them know I closed out my checking account or just let them find out. Everthing should hit my closed accout this coming week.
anna
I'm laughing here! My "evil" laugh! Let them find out when their debits are returned! It'll take them a while to figure it out! But, did you send letters to your pdl's revoking their debit privilidge? You need to do that if you haven't already done it. That way you have documentation that you revoked their debit privilidge. You have to do it in writing and send it to each one. Also put on there that you revoke any wage assignment that you may have signed. Send them ALL that letter via email/fax/USPS. You'll have your backup stating you told them to stop. You need to do that for your own documentation and also for the bank if they request it. They might ask you to show them something stating you revoked their debit privilidge. So send the letters, as I stated, and they will find out their debits are being rejected by your bank. I honestly think it's all just so computerized. It'll take them a few times before it dawns on them that they're debits are being rejected!

okay, I send letters to cease and desist and also to stop any ACH deductions from my checking accout for my records. This is alot of work. Talk to you later
anna
anna, don't forget to include on those letters that you revoke any wage assignment you may have signed (you may not have signed anything, but do it anyway to cover yourself) and also include that they are not to contact you via telephone at any telephone number they may have, only to contact you via email or USPS. This way you will have documentation of everything. Not to say they won't still call because they probably will, but at least you'll have it in writing you told them to stop. Have documentation of everything.
I did sent the letters, however, they are going to start harrass
I did sent the letters, however, they are going to start harrassing me right? I sent a letter stating not to call my job, my home or any third party. I filed a complaint with all but cashnetusa. I will do that today. ... I keep you updated.
anna
anna, don't be nervous. The pdl's may/may not call. Some of them actually do abide by your request not to contact you via telephone. Not many, but some. If they do call you, tell them to only contact you via email or USPS and hang up. They will eventually tire of calling if they can't get a "rise" out of you and they're start sending emails. This is good. You want everything in writing. Telephone calls are not good because you don't have documentation. Try your hardest to get them to only correspond with you via email or USPS.

yes, I filed an ag complaint and a ftc complaint. Also, I called to Cash Central to tell them I closed out my account and I e-mailed them and fed-exed them a letter to stop all ACH, however, they told me they are putting the ACH deuction threw any way because of the contract I signed. Although , I signed the contract it states I have to contact them in writing to in order to revoke any ACH deductions. Well, I did twice and I sent all my paper work to AG.
anna
Okay, you have it in writing that you revoked their authorization to debit your account. You filed your complaints. You've closed the account. They may say they're going to put the debit through, but your bank is going to reject it. If they contact you regarding this, tell them you put in writing that they are not to debit your account any further and that you have the documentation. Now, why did the BBB say they could not help you with this issue?

I believe the bbb could not help me because it was before all of this ach stuff, however, it just gave me another reason to file another complaint and i did. I have it writing twice, once via e-mail and another via-fed-ex.
