Email from Westbury Ventures saying Refusal to pay on my PDL


I received an email today from Westbury Ventures stating Refusal to pay on my PDL. I then emaile them back a DV letter and the PDL laws in the state of Florida. She replied to me saying that I have borrowed money under someone elses name but since she had my social security number she was gong to move forward with my socoal security number. Has anyone ever had a problem like this with this company? Your help is appreciated. Thanks


Katelyn- Westbury Ventures is one of the worst to work with, from what I have been able to find out. Did you take out a loan with them under someone elses name, or is she blowing smoke? How much have you paid so far, and what state are you in. Give us a little more info, and we can direct you to some solutions!..Karen :D

I've received 3 emails from them now, too, from "my Account Manager Garrett Kenyon". The 1st one was sent to me on 7/17/07, and I didn't respond since it was obviously a generic bulk email. It did not have any identifying info in it, so that I would recognize it as legitimate. (I am copying/pasting the emails into this posting for all to read) In the subject line was, "Refusal to Pay/Intentional Neglect - Collection Penalties Pending". The body of the email read:

"*If you are receiving this letter it is because you took out a payday loan from one of our subsidiary companies which you failed to pay back. This letter is being sent to 53 clients whose loans are scheduled to go into Default within the next 30 days. Once a loan is in Default, the debtor is given 48 hours to pay the full balance plus any fees. It is in your best interest to read this letter carefully and then contact your AM (Account Manager). Even if you can't make a payment this month - simply contacting your AM, you can get a hold put on your loan and save your credit from being damaged and stop more fees from accruing. If you have already made a payment arrangment with your AM, please disregard this letter.*





When a person intentionally neglects to pay back money loaned to them on good faith, it is an unacceptable act of deception. Because our Collections Department has not been able to obtain the slightest amount of cooperation from you to resolve this very serious matter, we have changed the status of your account to ???????Refusal to Pay/Intentional Neglect.???????



Through your actions (stopped payments, declined payments, accounts closed, breaking payment agreements, or ignoring calls) and lack of cooperation, it is evident that you have no intention of paying this account willingly and further actions must be taken. This change in status escalates the matter and seriously limits your ability to pay this loan back on your own terms.



However, there still remains a short window of time in which you may be able to reach a settlement and a payment agreement that will be comfortable for you. Please contact us immediately to discuss this. The consequences for the actions that you have taken were clearly explained in your signed loan contract, as were the means at our disposal to collect what????????s owed from reluctant debtors. To avoid these consequences, you must make a payment on this account by July 27th, 2007.



Note that making a payment in July of at least $100 will again upgrade the status of your loan. Additionally, providing a payment plan will effectively ???????Freeze??????? your loan, stop further fees from accruing, and keep your credit safe.

My 2nd email from him, dated 7/31/07 (came in after 6pm EST) had a subject line that read, "Clients - Today is your final day to save your loan". The body of the email read:

"Clients,

If you are receiving this email than today, July 31st, is your deadline to make a payment on your account.Those of you who have chosen to ignore this communication will have an unpleasant surprise awaiting you tomorrow morning.

Remember, extension fees are added on the 1st of every month. Most of you have $90 fees. Tomorrow that fee will be added to your balance, and you will have 48 hours in which to pay the full balance to avoid having action pressed against you immediately. A defaulted loan will stay on your credit for at least 3 years and make acquiring a credit card, another loan, financing for a house or car, a bank account - even a cellphone - difficult, if not impossible.

The minimum payment is $100. If you send in a MoneyGram today for at least $100, you will be doing many things. First, you will be guaranteeing that your account cannot be defaulted. Second, you will be given an out-of-court reduced settlement. For instance, if you owe $600, I will probably be able to cut it down to around $400. Subtract the $100 you sent today, and you will only owe $300 - and your next payment will not be due until 08/31/2007. Put frankly, you'll be buying yourself some breathing room.

Please follow the MoneyGram instructions below. For your Reference Number, you may either a) use your Loan ID # (call me at the number below to get this number), or b) use your social security number. When I read this email on 8/1/07, I (same-day) replied/responded with:

"I am unaware of a loan. Please provide me with the following information:
Name of original creditor:
Account number:
Date of debt:
Amount of original debt:
Itemized listing of fees accrued on debt:
New debt total:

(my name)
(my address)"

OK guys, this is where I got ticked off....his responding email, dated 8/1/07 (again, received after 6pm EST) was the following:

"I was just about to enter all of that information, Elizabeth, and then I checked the notes of your account and saw that you do indeed know about this loan. You had several conversations with the last Account Manager on your account, Eric Elder. The last three conversations you had with him, were when he called your job on January 24th, 26th and 31st. At that time you were supposed to make a minimum payment of $100, but you never did.

If you would like, you can call me at the number below and I will give you all the info you need. But I'm not going to waste my time writing all that information. Too many people use that as a stall tactic. The number is toll-free, and I'll give you all the info you need.

Since reading this asinine response this morning, I have been very busy. I submitted online complaints with the FTC & the BBB in both Delaware & Nevada (where there are addresses of Westbury Ventures, & also the dba's LTS Management (DE) and Zurich Ventures (NV). I absolutely refuse to call this bozo. My next move is going to be emailing a DV letter/Cease & Desist letter to "my acct mgr", since both addresses I have found in DE for Westbury Ventures are PMB's, not real office addresses. I'm totally drained from my all-day research on this slippery company!

Beth, I received the EXACT SAME LETTER FROM THEM!!!!!!!!!! One time, they sent it to no less than 500 people, and forgot to blind copy everyone so that 500+ people's email addresses were circulated all over the internet. I do not like the threat in "you will have an unpleasant surprise awaiting you tomorrow morning." These people are slime. I know you are drained but you are doing the right thing.

They are also in Kansas City, MO under the name of DMS Mktg. Beware of their sister co's. The address I have for them is listed below. Make sure you file a complaint with the BBB in Kansas City, MO. They also go by Xpress Cash, which Xpress Cash states they are in delaware aka; Loan Shoppe can various other entities, Mount Oread Ventures III, just to name a few. Pay close attention to your bank statements, it should say on their what co deposited the funds in your account.

OMG! You guys who are all dealing with this yo-yo operation, please get everything via email! Don't call them. Get them to only corresponde via email. They're burning themselves putting this crap in writing. All the more documentation you have, all the more to send in to the government agencies. I am amazed again (why?). Some of these pdl's are just insane. Do they not realize what the heck they are doing? Get everything in writing. No phone calls, please. OMG. Crazy, crazy stuff.

THIS STATEMENT CRACKS ME UP:
A defaulted loan will stay on your credit for at least 3 years and make acquiring a credit card, another loan, financing for a house or car, a bank account - even a cellphone - difficult, if not impossible.

HAHAHA...you're defaulted PDL will stay on your credit for 3 years.....isn't that a hoot, really? I mean, real credit issues stay MUCH longer than 3 years! :o About the only thing remotely true about this whole thing is that it might be hard to get a bank account, but, surely NOT impossible. Am I right here guys?

They are a bunch of jokers. Oh, and Ladybug, I did do a search on DMS Marketing since this rep's email address is from there. I have an actual business address of:

Kansas City, MO 64105

I'm not sure when I would have received a loan from these guys. I have only emailed the Rep, and he has refused to tell me anything via email or USPS. I stopped using my 1st bank acct around Sept/Oct '06 because of all the debits & fees associated with the PDL's, and I opened my 2nd acct in Oct '06. Some of the loans were deposited in the 1st, some in the 2nd. My 2nd bank is mailing me statements, but they only have them saved starting Jan or Feb '07. My 1st bank is faxing my statements from Aug '06 until the bank closed my acct in Jan '07 in the next few minutes. I'm hoping that will give me a better idea of what I've received, by whom & on which dates. I haven't a clue about who the Westbury Ventures collection attempts are for. Wish me luck in that the mystery will be solved with these bank statements!

Make sure you contact your ag's office and bbb. They do not like working with those agencies. Also file a complaint to the BBB in Kansas City, MO and in Delaware, also the AG's office in DE. That's what I did!!!!!!!!

Don't let them bully you around. Send them a cease and desist letter and a letter revoking ach's and all wage assignments if you haven't already. You will see them if you do a search.

I had submitted a complaint to the BBB of Delaware on 8/2/07. I listed all the known dba's & addresses. I stated as my problem:

["Westbury Ventures acct mgr emailed me with a generic statement that I owe on a loan. The email did not have any identifying information that this is a valid debt belonging to me. I replied to his email with a request for Name of orig creditor; Acct#; Debt date; Amt of orig debt; Itemized listing of fees accrued on debt; & New debt total". Today, 8/16/07, at 4:48pm, I received a voice mail on my cell phone from a "Gerald", regarding my BBB complaint. Since I have a few complaints on pdl's out there, I looked up the phone number on this site to find out that it was Westbury.

Anyway, I decided to call him back, very leary about what would happen on his end. He was very polite, stated that he was contacting me regarding my BBB complaint, then asked if my address was still the one he had, then stated that he was sending the information I asked for in the mail "as we speak".

So this means that I should be receiving it by 8/21 at the latest...

ladybug is right. I'm glad you filed with the BBB and are going back and forth with them. However, you must also file with the FTC (www.ftc.gov) and your state AG. Google your state attorney general and the site will come up. File a complaint under consumer protection. You need to go through more than one agency. The BBB will only give it a couple "tries" before they close it. File your complaints with the other two agencies.

I filed another complaint against Westbury Ventures this morning, this time with the Ohio AG's office. If I don't received my DV letter, with ALL the info I requested, by this Tuesday 8/21/07 (they said they were putting it in the mail Thurs 8/16, USPS would have picked it up Fri 8/17, for up to 3 days usual USPS delivery time), then I will file a complaint with the FTC as well.

From looking at my records, it seems that I have not actually made any pmts to Westbury/DMS Mktg/Loan Shop/etc. I'm not looking to skate out a debt, just only being liable for principal and state-allowed fees/interest.

Beth, you need to file the complaint with the FTC don't wait around for them to send you anything. They are using that as there "stall tactic". They know that they are operating illegally and are banking on the notion that you don't have a clue about this whole thing.

They figure that they are dealing with someone they can push around. Don't let them. If you have any frustrating conversations with them, hang up, don't speak to them, you sent them a cease and desist letter so they are violating the law by not honoring that. If you haven't sent one, I can't remember if you did or not, if not send one out immediately. Send it by email (save a copy) and fax (if you have a fax machine and save the coversheet) as they seem to only want to deal over the phone and not by email, just to send you the generic "we are going to get your" (LOL)

I received about 13 of those with like a 5 day time frame. Don't let them get your riled up...it makes there day.

Shouldn't I wait another day or two before sending a Cease & Desist letter? If Westbury did really mail my DV letter on Friday, then I should receive it by Tuesday. Then if they haven't complied, I can reply to the BBB complaint that they called to say they were sending me the info but never did. Then I can complain to the FTC, and send in another complaint to my state's AG office. ---shouldn't I go about it like that?

beth, that's fine. If you want to give them a few days to see if they live up to their end of the bargain, that's okay. It's your decision. If Friday rolls around and you haven't seen anything, then go ahead and proceed as you like. You do what works best for you. :D
