Being Threatened with Legal Action.what to do?


A collection agency has bought my credit card debt. Now over the last 2 years it has been passed from one collection agency to another(all of which seem to be in connection with ONE lawyer. Its impossible to set up payments as when we call to do so we get paperwork back asking for our budget and what we can afford. Now that sounds great, BUT the minute we send it back they sent it to ANOTHER agency. Now the current agency wants more money then we can afford a month or they plan to take us to court. Any suggestion on what we can do would be helpful. They plan to garnish his wages, if they do so it will leave it in serious problems, as he has the only income and we have a 2 year old. Can they take our car is another concern, its by no means a new car. Its a 1994 Buick.

First of all, how old is this debt? the SOL may have run out on it in your state.

Second, have them produce how they have come to the "total" figure of what you owe, this is called Validation of Debt (VOD), and sample letters on this site can help you draft that..

It is your Civil Rights by way of the fdcpa and FCRA to have this information made available to you.

Second :P join and become a official memeber of the forum..(not required for help tho), and learn just what your rights are, and have the wonderful memebrs to help you by what they have learned themselves, or the Admins know.

Since finding this site froma google search looking for guidelines/help, I persoanlly can not think I would have found a better link to click on that took me here.

Hi,

Welcome to the debt consolidation care forum.

I understand that you are passing through a trying time. My suggestion to you is to get in touch with the root person. Contact the Original creditor and express your wish to settle the debts you owe in affordable monthly installments.

Also mention the harassment you are facing with the frequent change-over of collection agencies. Your credit report is a proof, as it will reflect the change in Collection houses who are trying to collect your debt amount on behalf of the Original creditor.

You can also take suggestions from the Original creditor about the preferred Collection agency. Keep in mind your affordability limits every month, while fixing this deal.

I was reading your post. Unforunately I am being done the same. I am trying to get settlement amounts and as these are credit cards and medical bills can they take you to court for this? I want some how to borrow or refinance the settlement amounts do you know if this can be done? Thanks and good luck, not fun being sick and having to deal with ALL THESE PHONE CALLS AND THREATS. wE HAVE 34 YEARS OF EXCELLENT CREDIT AND ONE YEAR OF BAD DUE TO MEDICAL CONDITIONS.

THANKS JASON, UNFORTUNTELY I DID SOMETHING REALLY DUMB . ALLIANCE ONE WHO IS ONE OF THE COLLECTIORS CALLED AND DEMANDED THAT I SET UP A PAYMENT OR THEY WOULD SEND BACK SAYING I REFUSED TO CORPERATE. I TOLD THEM I WAS NOT REFUSING I JUST DID NOT HAVE THE 1600.OO THEY WANTED THEY THEN SAID 1,000 THEN 500 AND THAT WAS IT THEY MADE ME TALK TO 2MEN WHO WERE VERY RUDE AND THEN A LADY WHO SOUNDED NICE AT FIRST I EXPLAINED MY DILEMA AND TOLD THEM THIS MONTH I COULD NOT AFFORD OVER A 100 AND SHE SAID THAT WOULDN'T WORK AND SHE TALKED ME IN TO GIVING HER MY BANK ACCOUNT AND SAID IF I COULD COME UP WITH THE 5OO TO CALL BACK BEFORE IT IS TO SENT THRU ON THE 26 I SEEN ON THE 15 THAT NO WAY POSSIBLE WAS I GOING TO BE ABLE TO GET THE MONEY AND SHE SAID I HAD TO BECAUSE SHE WAS SENDING THE CHECK THRU AROUND THE 24 AND I TOLD HER THAT WAS NOT OUR AGRREMENT AND SHE GOT LOUD AND SAID SHE DIDN'T CARE ABOUT MY MEDICAL PROBLEMS OR ANYTHING ELSE THEY WAS GOING TO SEND THIS MONEY THRU AND NOW I DON'T KNOW WHAT TO DO. CAN I CALL THE BANK AND PUT A STOP ON THIS OR SHOULD I CHANGE MY BANK ACCOUNT I DO NOT NEED ANY MORE CHARGES AND THIS WILL NOT GO THRU BECAUSE I DON'T HAVE IT. I KNOW IT WAS REALLY DUMB OF ME TO DO THIS. I ALSO AM PRETTY SURE I CAN GET A CONSOLIDATION LOAN BUT THEY SAID THE EARLIES WOULD BE EARLY MAY. HELP . IF YOU HAVE ANY SUGGESTIONS I WOULD APPRECIATE THEM. THANKS

Hi src,

As I said you earlier in another post, keep in touch with your bankers as they might do the favor as it is in your rights. Also, don't delay with your payments further as it will add some more interest charges.
