I have a loan with Cashcall which I've paid on every month with one deferral about 2 years ago. In March I got behind on a payment of $199.02, I've not been able to catch up the payment but have been paying them $200 a month since and am not behind on any other payments. Last week I received a call from the Loss Mitigation department telling me that I abandoned my loan and unless I make a payment of around $600 (that's the $199 missed payment and all the fees that it accrued) by this past Friday, they were going to proceed legal aciton against me. I explained that I didn't get paid until the 31st but that was not acceptable to him and he proceeded to lecture me about how I shouldn't have gotten behind and blah blah blah...I asked him not to lecture me at which point he told me that I needed to be lectured and I was irresponsible for getting behind...so I hung up. He proceeded to call my employer and when he couldn't get to a manager, he insulted, threatened and harrassed my receptionist. I faxed a cease and desist letter immediately letting them know they did not have permission to contact my employer without a court order and to direct all communication regarding my loan to only me. Well today when I was at break, he called again and this time went through 4 different people yelling, threatning and harrassing my co-workers, going as far as to tell them that they were aiding & abetting me. Furthermore, he pulled up old information about my company on the internet and bagan naming off co-workers in other offices that he was going to start contacting if no one here would help him. Needless to say my company is not going to cooperate with them but I'm wondering if I can file a harrassment complaint against these people and if so, how & where?? They must call at least 10-40 times a day - no joking.

Now in the time that I typed they have called back and said that I was trying to get out of my loan by sending the cease & desist letter and he further said that he called my CEO to get the information he wanted after I sent my cease & desist letter and he said he made a complaint against the other coworkers in my office for not assisting him. HELP, I have not evaded this loan I just got behind!


I know Cash Call is licensed to do loans; however, aren't these illegal collection tactics? Has anyone (and I know there are a lot) dealt with Cash Call and been in this situation so that we can help and find out what can be done to stop them from calling this person's place of employment? And, also, how to go about making complaints regarding their collection tactics???

I think your best bet here is to contact your state's Attorney General, and perhaps the state's Attorney General for California, where Cash Call is located. Report the incidents to them both. Find out the laws regarding recording phone calls for your state, and if legal, record some of those threatening phone calls and save any messages you receive. Document in writing the dates, times and content of any phone conversations you have with this company. Make sure you take names of the people calling you. If you have a copy of the cease & desist letter you sent them, keep it for presentation to your Attorney General with your complaint, if they request it.

Don't let them get away with this. Just because they are backed by a bank, and therefore are a legal lending entity (although hiding behind that front and performing what amounts to loan sharking), doesn't mean they can break the law under the fdcpa.

If you sent them a cease and desist letter, and they did not honor it, sue them in Small Claims court. They have violated the law, and despite popular what some might say, they DO have to follow collections laws, even if they are the original creditor.

There are also state collection laws, which I would think they are breaking. The fdcpa only applies to thrid party collectors, but most state have similar laws for the original creditor too.

I would call your state's DFI and see what they suggest. I would bet they have had many complaints against this company in the past.

Well........Yep!....I had obtained a Cash Call loan, as well. Same thing happened.....they called my employer..and so forth. I was a month behind, in a payment. They said I owed all of these fees, etc. Here was 'the deal', in my case. I am in the military. My 'chain of command' stepped in. Since that happend, I haven't heard from them since. HOWEVER, Cash Call can come back and try to sue.ONLY at the % rate of the state u live in. Here is my question.......I do have some Payday loans' haning out there'. Does anyone know how I can consoladate them, without the high % they ask for?? Thanks=

Please post the following information:

What state you live in?

What companies you have borrowed from?

How much?

And how much have you paid back so far in fees?

I know that in some states there are special laws regarding payday loans and the military.

As far as Cash Call goes - I would be a bit worried. What they are doing is waiting for a while before they sue you. As you know, once they sue and get a judgement against you the interest rate is set per your state. So they will wait and wait before they sue you so that your loan amount grows and grows. If your interest rate is consistent with their normal rates, a $1500 loan could go up to $3000 in just 8 months . . . . Add on their late fees, nsf fees, and such, and you will owe a ton on that loan in no time flat.

Well I was talking with the daughter of my mom's friend and she was telling me that I should let them take me to court. She said she defaulted on a loan with them and they harrassed her for about a year and then finally took her to court. When they did, she was able to work out a deal with them where they waived all her interest, applied any past payments to her principal balance and as long as she makes payments on the remaining balance of $75/mo, then they won't put it as a judgement or write off on her credit. They're not even assigning her wages for the $75/mo.

Also, I called to make a harrassment complaint against the man who called around my job and was told by another rep that "between her & I, the company was severely in debt by the millions and about to shut down due to defaulted loans and she is seeing some of the collection representatives taking aggresive tactics to try and make people pay back their loans", almost like fight or flight. I found it quite interesting that when I checked the BBB site, that this company had over 400 complaints in the past 3 years for not abiding by the terms of their contract, but were still getting an A rating.

Well..........since my 'chain of command' ( in the miltary ) stepped in, I haven't heard from them since....and that was in March of this year.I have talked to different lawyers, etc. and they are telling me the same thing..........the % rate, Cash Call holds, is aqainst the law. I live in the state of Pennsylvania. I've barrowed from other Payday loans, as well. Cash Call I barrowed $2500. Other payday loans was about $700 all together. Thanks for the reply. Just trying to get somethings off of my credit......get alittle bit ahead. Being a single mom is tough. Was wondering if anyone knows any legit work, from my own PC, to earn some extra income...or any ideas toward this subject? Thanks for your reply.
