Need some direction with my 8 online loans. Please!!
I am currently just talking with a Debt Negotiator who is has suggested to cancel our checking account and or put a stop pay. I'm just not sure which to do.
I have went as far as I could and now I have to result to this to avoid losing our house or car.
I have already consulted with our bank and they are fine with doing either once we decide. I know Each state has rules on the maximum amount of percentage paid.
I am in Indiana I know some laws for payday loans limit or prohibit practice in each state does this apply for online loans? Does T&C or other
programs help prohibit the collection process while a
agreement is reached ?
If so and I have already paid more than the full amount financed are we able to settle without paying them anymore ? Thanks for any help possible

The issue with blocking the companies is that if they change their name or amount of debit, they can still get through as most blocks are explicitly set to block exactly the name and $ that the bank enters into the system. The best solution is to switch accounts, but, only after you check state laws and make sure everything is legal. Also, you need to send letters to these companies, fax, email and certify mail them to the physical address for backup that you notified them BEFORE the debits were due to be withdrawn that you REVOKE their right to debit your account.

That is the first thing that you need to do to get these places out of your wallet and take back control of your finances. You have well overpaid most of these loans. The only one I know off the top of my head that is legal is CashnetUSA. They are licensed in all the states they loan in and work like a storefront. You will need to make contact with them after you close your account and make payment arrangements with them to pay off the balance. I am sure BIG, Geneva Roth, and US Fast Cash are not licensed in your state but I'm not familiar with the others. Maybe someone else can help me out on that? You are only responsible to pay back the principle and legal interest for your state so I would say you are done with most all of these. T and C will consolidate the loans for you and then make them weekly payments but I think that you have so overpaid these that it will not be necessary to hire them!!!! It will just take a little work and a thick skin for a couple weeks while these places try to bully you but I rally think you can do this on your own. However we will be happy to give you info for T and C if you would like it. :)

We can work with you here, if you choose to. You have overpaid these people. EDESC is a d/b/a. I can not remember which pdl for though. It jumped out at me because that is one of the debits I had coming out of my account. I just can not remember which pdl name it was. But it is a d/b/a for someone! And I know my pdl's were not licensed - so they probably are not & you paid them a lot! ameriloan and US Fast Cash are MTE Financial - illegal. Big is totally illegal, as sassnlucy stated. Whitesands is the name for It's My Pay Day (maybe others)- not licensed. You must decide what is best for you regarding how to deal with this situation with the pdl's. You can do it on your own, especially since maybe ALL of them are illegal. We've named most of them already as illegally lending. Plus the fact that you've overpaid them. We can help you if you want to do it on your own. But, as sassnlucy stated, it is work and it takes time and it's stressful - but that's what we're all here for. We can help. However, if you don't have the time or the energy or want the undue stress of it all, then by all means try to work with a company. But I must say, you've overpaid. Personally (and this is just ME and MY opinion) I wouldn't pay a company to pay these people any more money since you've overpaid and they're not operating legally. However, that is just me. Me alone. You know you're situation and what is best for you. Whatever you decide will be the right answer. But, if you choose to tackle it yourself, we are here and there are many, many others who can help you through it. But let me repeat, the choice is yours. Whatever fits your situation.

So it sounds like Cashnet may be the only full legit one. With the ones that are not licensed in my state do I only owe the principal on those, or the principal and the maximum state allowable interest or nothing?
I think only US Fast Cash is the only one other than the legit Cashnet that I have not paid at least the full balance of the loan.
I know I just can't just call them and tell them to stop though. Do I need to send them a letter via certified mail like some suggested or is there another way to begin the process for them to cease and desist and admit they have been paid in full if not well over at least for some.
I'm only upset that I did not find this forum sooner!

Check with the FTC, Federal Trade Commission and your Attorney General's Office to inform them of the money that you over paid.

First off, deal with CashNetUSA, as they are the only licensed one. You are in Indiana. I can guarantee the others are not licensed in your state. Set them to the side. Concentrate on the licensed one. Whatever you have to do to make payment arrangement with them. I've read some good things and some bad things about them, but since they're legal, you've got to pay them. As for Anthony's advice (and I do so love him!) if they are not licensed to lend in your state, they are doing business illegally. However, there is another forum member who is in Indiana. And we've gotten confused regarding her DFI (Department of Financial Institutions). We can't quite figure out what he was saying. However, my suggestion is to just to deal with CashNetUSA and your bank account right now. Do not even worry about the stupid MTE one. Honey, I can bet you now you've overpaid them even if you've only made one friggin payment! They are so evil. I really believe you can tackle this on your own. However, do as Anthony stated. File your complaints with the BBB, the FTC, the state AG and the DFI, if you want. But file them. You can send letters to these people stating your laws/their illegal lending/revoking debit authorization/revoking any wage assignments/etc. We can help you with that. You let us know what you decide.

So please check with your state's dept of financial inst before you decide to not pay a company a dime just because you can't find a license . . . . You could be causing yourself more trouble.
However, if the company isn't licnesed ANYWHERE - Then they are operating 100% illegally and then legally you could not pay them, although I personally think you should pay back the principle you borrowed, just so you aren't on the same level as those pdl company thieves.

I personally do not think this is right, and would never use a technicality to get out of paying what I borrowed. I don't think that it's right to go and screw them because they are screwing others. That makes you the same as them. Pay back principle, not a dime more, but by not paying them back at all gives them the ammo they need to go to state capitol's and say that they have to charge such high interest rates, because the loans are so "risky" because all these people won't even pay them back. In the end it almost helps them out!

Sometimes it can be fast, but other's have had to work very hard for long months to get what was owed to them. Just contacting your AG's office and the FTC doesn't always do much, especially when the laws of your state aren't exactly consumer friendly.

As it stands now it was always intended that a pdl should be licensed but not stipulated as such anywhere. They passed a new law as of 07/01/07 that states if a lender lends to 25 times in a calendar year they must be licensed by the state of Indiana or the loans are null and void. This however doesn't do much for those of us with previous loans I have learned. I had 10 ipdls..I have 2 pif's and 1 that has offered me a new loan (DUH) and has not tried to collect since my cease and desist letter...in my mind that is another pif. File with the AG,DFI and BBB...as I have done..and then send your letters and follow up. If enough of us follow that senerio, the authorities will have to pay attention and we will get more help.

Thanks again , I called the IN Dept of Financial Instituitons And from what I was told none of these including CashNet USA are actually licensed.
Now the company from what he told me has to either be licensed in the state or obersve that state's lending laws.
As mentioned elsewhere, he indicated if these non legit companies give you a loan after 7-1-07 According to IN law the contract is null and void, and yes that applies to internet loans.
Although he instructed me that it would probably be best to go ahead and pay the only two that I had yet to pay the actual balance and allowable interest, instead fo trying to fight them in court.
I already called the Attorney General's office and I am faxing in the information on all of these, and they will be sending out a notice of complaint and stop any collection effort.

guest - Do you know who your pdl was with? Cash Borrower? Instant Loan Today? Dollar Quick? I had the same experience while trying to call. You get a big run around. Different phone numbers, different names....etc. Just drove me nuts.
janet - Good! As long as your account is closed (and please, God, let it STAY closed!) and no pdl debits can hit anymore, you're going to be in good shape. Your paycheck is yours. You'll be amazed at being able to pay your bills again!

about all of this insanity. It was so bad for a while i would wake up ( if i was able to sleep) and check my account on line in the middle of the night. All I could concentrate on was where the money to live on would be coming from. I was always crying and in panic mode. Actually had to see a dr. for meds to help the panic attacks that were taking over my life

Cash Borrower is BAD. I also have them on my pdl list. You need to prevent them from debiting your account any further. Have you taken any steps towards closing your bank account or at least blocking debits on your account? This is your first step. My experience with them is that I overpaid, blocked my bank account so they could not get any more money, sent my letters in to them demanding a refund, filed all complaints with all agencies and I have never heard a word from Cash Borrower again. They did not respond to the BBB (surprise!) and now it's in the hands of my state AG. I don't expect to see a refund, honestly. But you need to get that bank account taken care of ASAP so they can not debit any more. Please post if you have any questions!

If it says cash borrower vp or whatever it says, it's a debit from Cash Borrower. They also go by Dollar Quick, if that means anything to you. Here's the information I have on them:
