Per the Attorney Generals office, I was told that whether or not a company is in the state, if they are dealing with a person in the state of New York and deposits money in that person's account, then they are conducting business within the state of New York, (see below), regardless of where the loan was originated from and the laws of the state of New York apply.
I guess I'm not the only bulldog out there because I don't think either one of us are going to be giving in anytime soon.

Welcome to the "merry go round"! Don't you love it? When these idiots do this to me (and many have) I re-send the letter stating that they NOT contact me via telephone, only via email or USPS so that I may keep accurate records of all communication. Every time they email you - put that sentence and email it back. Email it to them every single day. 20 times a day if needed. Fax it to them. Plus - I would file complaints again regarding the fact that they are not complying with your request not to be contacted via telephone. Even if you just file with the BBB. Whenever I file again (Lord, Lord, Lord), I make sure I put in BOLD that they are still continuing to contact me via telephone regardless of my numerous attempts at informing them not to. Hell, email them until they're tired of you. Of course, don't take the calls. And file a complaint AGAIN with the BBB.
