GOD! HELP!
Cannr, please calm down. You have been putting up such a fight
Cannr, please calm down. You have been putting up such a fight and had a lot of victories, so it's too early to give up. You are in the right...I am struggling to keep up with your posts, girl...I'm just barely catching up on the East Side lender saga.

Cannr take a deep breath. It's going to be OK, really. They can't get blood from a stone now can they? Remember our motto - tackle one at a time. So pick the worst one out of the bunch and respond to that. If you still owe principle then make a payment plan offer you can live to - if you don't owe them anymore than hang tough. We will win over MTE, there are too many of us fighting them to give in now. Ignore the other emails until it is their turn to be dealt with. You can do this - I know you can!
You didn't commit fraud...if you were committing fraud, none of
You didn't commit fraud...if you were committing fraud, none of these places would have got any money after one pay period! You DID NOT close your bank account right after getting the money...if you did that, then they'd have a case for fraud. I know you have a record of your bank statements, and if they accuse you of "taking the money and run" just make a copy to your AG, DFI, or whatever and copy to US Fast Cash. These people are making me steaming mad now! They are off their rockers!
Exactly, they can't do anything to us, remember? They are ILLEG
Exactly, they can't do anything to us, remember? They are ILLEGAL! So, what's the worst that could happen?? Just ask yourself these questions each time one of these idiots e-mails you!
You are better off if MTE turns you over to ARM for collections.
You are better off if MTE turns you over to ARM for collections. They cannot validate anything and give up. One at a time is the way to go. I forget. Which ones did you overpay?
Frogpatch is right. I know that this sucks, as I have the MTE d
Frogpatch is right. I know that this sucks, as I have the MTE drama saga, too. But, canr, you have been so strong in putting up the fight, YOU CAN WIN!! Giving into the fear is what they want. Keep your can do attitude with them, and tell them where to go. If anyone can do it, you can!
Hang on, Cannr! Don't let them push you into this state. That's
Hang on, Cannr! Don't let them push you into this state. That's what they want. They want your fear and panic so you don't fight them and just give in and send more money. You have given more than enough! Keep fighting and tackling one at a time. You have the determination and strength. Take a moment to settle yourself. Know that we are all here for you- You're not alone. Keep fighting these jerks! You are right. They are wrong.
It's okay - They claim everyone is commiting fraud - I was sent
It's okay - They claim everyone is commiting fraud - I was sent to at least 7 "fraud invesigation" deptartments - And I actually put fake references on my applications - I'm still here. They are just trying to scare you. No one is really going to investigate anything.
It's just one of those days for you - But soon enough you will be through with these companies! It's isn't always easy or fast, but that doesn't mean it won't happen.
Thanks
Oh, you guys. You're making sense, but I think all of this coming down TODAY is making me nuts! US Fast Cash I still owe towards the principle. They only got one debit of $105.00 and it may have even been returned. Hell, I can't keep track anymore. One Click Cash is paid according to my state law maximum. Eastside Lenders I still owe towards the principle. They didn't get their debits, they were rejected. So - out of these 3 (and of course I still have others) One Click is paid as far as I'm concerned. US Fast Cash REFUSED to correspond with me, as I was trying to set up a payment plan for the amount owed according to my state pdl law. No response to my asking for payment arrangemens. Eastside Lenders is tripping me out because still owe the principle balance of $300; however, they're stating $560. I swear to you guys, I have tried and tried and tried to contact these pld's that I owe the principle amount on, stating that I am not denying I received funds, let's work something out. I get nothing. Then now everyone wants their money NOW and it's over the legal amount and I'm committing fraud. Is it fraud? If I've tried repeatedly and included it in my 1st pdl letter (the ones I still owed money to) that I am willing to pay the state maximum, blah, blah. Is that fraud? I'm not trying to hide from these people. I have been contacting them. They chose to ignore me. However, I'm scared to friggin death at this moment.
No - It is not fraud. You are not doing anything wrong. You wi
No - It is not fraud. You are not doing anything wrong. You will pay what you legally owe, but these companies will not accept that. That is their fault. You are trying - they are the ones that aren't cooperating.
goudah
Thanks, goudah. I swear, I'm having a nervous breakdown today! So, before I respond to my pdl's emails today, should I state AGAIN (so old!) my state law maximum and that is what I will pay? And, also, how about going about getting away from the "pay by date" they gave me? Hell, all of them want their money on the 27th! Hello! Not possible! I need to know how to respond. Please continue to help me, as I'm not doing very well here!
Yes, respond with your laws again, and outline a "plan" to pay t
Yes, respond with your laws again, and outline a "plan" to pay them back. I would just state that the date they gave is not possible at this time. Give them a date when you will be able to pay, or make payments, whichever works for you.
Seriously, please don't freak out about this. You know what you are doing. They are saying these things to scare you. They want you frazzled and worried and doing everything you can to come up with the ridiculous charges they want. They are playing hardball on you. Don't let them win!
Don't let them get to you! They aren't even legal in your state
Don't let them get to you! They aren't even legal in your state, and they don't have a leg to stand on, even if they pressed charges. It is too expensive for them and they know the judge would just laugh in their face for wasting time. They are TOYING with you, and these are empty threats because they know they can't do much else...just think about it, if they were really serious about any of these trumped up charges they would have done something a long time ago instead of calling and emailing you and resending emails back to you. Doesn't that make sense?! They are blowing smoke...tell them to take a flying flip off the bridge themselves.
When I was dealing with oneclick, I forwarded any e-mails I got
When I was dealing with oneclick, I forwarded any e-mails I got from them to my DFI for proof that I was trying to settle with them. In my last e-mail I stated that I have sent copies of every e-mail they sent me to my state. Thats when they finally got back to me and agreed to the settlement I offered. So if you still have the e-mails stating that they will no longer talk to you and then get these e-mails telling you that you comitted fraud because you are refusing to pay, send them to your DFI, AG etc.
Keep up the fight, don't let them get to you like this. You are strong and have come so far to let these people get to you.
joshua
Thanks, joshua. I guess it really SHOULD be them going off the bridge and not me! LOL! Please, you guys, just keep reassuring me I'm not committing fraud or attempting to run from the law or whatever. I swear, this stuff makes me not sleep at night. It pisses me off, but at the same time, it eats at my brain. I get really nervous when they throw "fraud", "investigation", "arbitration" terms at me. And I get all freaked out of pay date deadlines. Hell. I don't have any money! And I'll be damned if I'm not paying my car insurance and my electric bill this week because they want more money. And as for next week, that's rent time. All money gone. So what the hell am I supposed to do? I can't come up with this money right away. Oh Lord..........
puddlejmpr
puddlejmpr - thank you. I have EVERYTHING. I have the emails these idiots sent me telling me to go away. I have the emails these idiots sent me saying they "were not that company". I have EVERY SINGLE THING. Including my attempts at contacting each and every one of them before they had to contact me. Along with the ones that didn't get their debits - I have dated letters, emails, etc. showing that I tried contacting them, explaining the situation, and wanting to set up payments. So - I guess that would show I wasn't attempting to "steal" from anyone. That I did not deny receiving a loan. And that I made numerous efforts at trying to get a payment plan. So, is that fraud? Technically? Morally? What? But, you've made a good point, puddlejmpr. I've got it all. And I'm going to print it all and send it all to the AG and the DFI and beg for assistance. Do you know how much stuff this is? Oh Lord. I'll have to take a wheelbarrow to the post office to mail all this crap.
In NO WAY could any reasonable person possibly think what you've
In NO WAY could any reasonable person possibly think what you've done is fraud. You have documented every step you have taken to try and resolve this with the companies.
So technically, morally, everything - NO! You have not commited fraud in any way, shape, or form.
Thank you
Thank you guys so much. You make me feel more at ease anyway. The last thing I ever intended to do is "fraud". Hell, I've been trying to get through to these people! Guess it's time to print everything out and copy everything and get it out once again! Thank you!

I think you should cut off all communications with them. The loans were illegal so they can not sue you and win. If it makes you feel any better than pay them what our state laws would allow them to be paid if they were legal but don't call them, email them or mail them anything. Just send them a check and ignore the rest of their calls/emails. It would do wonders for your well being.
Dollars, it would be nice if cannr just paid them the state laws
Dollars, it would be nice if cannr just paid them the state laws and be done with it...but this doesn't seem to be the simple issue here. They are all demanding that she pay OVER what the state laws required, and in some cases she has already overpaid and they still want more money!

Yes, but I think what Dollars means is, there is no point in continuing to communicate with these people because they are unreasonable and unaccomodating and they are breaking the law. So, what's the point, it's like running in circles.
If you feel you want to pay them what you owe them, plus the interest your state allows, then do so. After that, there's nothing they can do (actually there's probably nothing they can do even if you pay them nothing, but the majority of us want to at least pay back what we owe.) Trying to talk to these people is equivalent to banging your head against the wall.
dollars
dollars, I really think I agree with you. And, joshua, I agree with you. However, on almost all of my pdl's I have paid or overpaid. But - there are a couple that I do owe the principle amount on, as the debits were blocked. But I tried repeatedly to contact these companies and work out a payment plan and let them know the debits wouldn't be accepted. That's what's got me in a tizzy. Dollars is right in the respect that they're driving me to the brink of insanity & making me sick to my stomach. But Joshua is right in the respect that I've been fighting and trying to get results and gotten ignored until now and now they're making demands and threats. So that's why I'm torn. I feel like I want to point out that I've been doing this for TWO MONTHS and getting ignored and now I'm getting jumped on by all of them at once demanding money all on the same day! It is not possible. Thank you guys for listening and helping. It's really not been my day today!
I would not bother contacting them and working out a payment pla
I would not bother contacting them and working out a payment plan with them. Just formulate your own plan and pay them accordingly. Send them a check in the mail and if they cash it great if they don????????t great. If it were me I would list them in order from smallest amount owed to largest amount owed according to my calculations and work my way up the list paying each one in full as I had the money. For example if you owe by state law 100,200,200, 400 then I would pay the 100 the first month then one of the 200????????s the next month if you had enough then make a couple payments on the 400 until you paid 400 total. Do not get complicated in your figures of what is owed just take one estimate and stick with it. I would completely ignore their communications. If they really want to collect they will sue you and you will get contacted by an officer with a summons. This will not happen though because these loans are illegal in our state and they would lose the suit.
dollars
Thank you, dollars! You always give good advice! I like the idea of just sending them money. I'm sure they'll take it. It would be money orders. I just need to find addresses to mail them to. You really put me at east, dollars. Because they are stressing me WAY too much! And if I do what you suggest, I could get them money, so that's a good thing. And I could also do it at what I can afford, so that's a good thing. You're wonderful, dollars! Thank you so much!!!!!
Make sure you keep a full record of what you sent them. I doubt
Make sure you keep a full record of what you sent them. I doubt you will ever need it but its good habit to do this in case you settle other debts that have more legal clout.

Yeah, that's good advice! I know several people that have had to do that with Cashnet USA because they refused to accept payments.

Dollars, you are totally right in that she should stop communicating with them and just send them money! lol These companies don't seem to get it on paper anyway. Definitely do as Dollars suggested and get an amount you owe and stick to that. And make sure you keep copies of your money orders AND send the payments via certified mail...that way you have your documentation and receipt (I know how much you love that cannr ;) I've been doing that with CashNetUsa and Cashcentral too. They were pretty stubborn about what they would and would not accept, but in the end, they were happy to get anything from me. As we speak, I'm off to the post office to send $20 to Cashcentral.
I forgot to add, but if they send you revised statements of what
I forgot to add, but if they send you revised statements of what you owe, be sure to check the amount is going down after you've sent the money orders!

cannr-I am really late coming to this thread but please, please, please don't let thes people scare you. So many times I was accused of fraud too!!! As well as writing bad checks, and one of my co-workers was told that I am a "runner!" You are so strong, don't let these places beat you down. They are so not worth it. Just keep up the good work and stay tough ok?

Cannr...I too am reading this after the fact...I don't have access to an outside computer line at work. Everything that could/should have been said has been...so let me just add this. Remember what you told me a week ago when I was freaking out...don't let all our work be for nothing...if you even let them give you a head ache, they win!!! Don't let that happen..they are not going to come knocking on your door..they are not going to take you to court..one step at a time my friend...you do what you have to do first and take care of them 2nd..
kind
You're all so kind! Thank you! Just been a hell of a pdl day! And, you're telling me to make copies of everything and have documentation? Oh my God! I think I need to be crowned Queen of Documentation! I even make a copy of the friggin envelope I mail the friggin money in! LOL! Copy of the letter, copy of the money order, copy of the envelope, along with the post office's certified return receipt information! LOL! Paranoid! And in each one, I could put the total amount at the top and subtract each payment and date and go down the line. Oh, I so love documentation. I'm going to attempt this. I'll send them money orders. Take them or shove them. It's money. And, honestly, they're lucky they're getting it. Oh. Attitude again. Sorry. But, now I get to go through all this garbage and find mailing addresses that are GOOD! They have so many addresses. But I think the BBB was good because they have it on their files - the "real physical" address. Hmmmm.... have to look those up. Okay. I'm up again and ready for the fight. Here we go. Thank you all so much. I was defeated today, but I think I can muster it up and shake it down again!
You can do it! Go cannr!!!!! You are right about the documentati
You can do it! Go cannr!!!!! You are right about the documentation. You cannot afford not to document everything with these places! And you were never defeated. You were just tired!!! Don't apologize for your attitude, either! Just give all the attitude to the pdl companies!!!!!
