Companies not licensed to loan in the state of Kansas


i need to know Kansas laws it seems tha the payday loan company i went with were not suppose to loan to the state of kansas i have someone who works on the inside but don't know if there is anyhting i can do about this have been paying on one of them since january of 2006 and that was for a 3oo dollar loanand the other one was a 200 dollar loan and have been paying on that since december of 2006 please help me in anyway you can.

That is Kansas law regarding payday loans. The only thing I can figure they were talking about is that they aren't licensed to lend in Kansas, but usually this company could care less about where they lend to or what the laws are.

billy, you've been paying THAT long? Who are your pdl's with? Are they internet loans? I'm assuming, but can't always assume. Which internet loans? One is for $300 and one is for $200. How much have you paid on them?

KANSAS INTEREST RATE ON SMALL LOANS IS 15 FOR EVERY 100 BORROWED. THE MAX LOAN DAYS IS 30. 390%

Don't pay another cent. send and email or letter entitled "Revocation of authorization" to debit account XXXXXXXXXX. Tell them that they are making illegal loans in kansas and include the Kansas Attorney Generals name and address as a cc to in the letter. tell them that you will ask that the AG for kansas sue them for violating kansas law. look up the kansas dept of financial institutions and include the address in your letter. It is a violation to require electronic debits as a condition of an extension of credit. You can stop the electronic debit anytime you want. They can not insist on them. Tell them you know this. it's in the electronic funds transfer act. look online. Ask for a refund for the amounts your paid them over $345.00 prinicpal and interst. That's all you ever owed on a $300 loan in your state. Know that they are bound by the laws in the BORROWERS state not the laws or lack there of in tehir own states.

There is actually a case going on right now in Kansas deciding if internet companies have to follow Kansas law. The company was ordered to stop giving loans, and in turn sued. This case has not yet been decided. So it is not so black and white that they must follow the laws of the borrowers state.
