Some advice please


I like many of you are in PDL Hell. After reading this forum for the past couple of days I have really learned a lot. This morning, I faxed Cashnet USA and Cash Doctors of Utah a letter revoking their privledges to debit my checking account. Thanks to this forum I am now educated on the rules, regulations and laws of my state (Florida)I also mailed it certified, return receipt requested. Then I contacted my bank and they told me that I do not need to close my account at this time, they would note my account and should they attempt to debit my account, then I could file an affadavit.

I'm new at this part of the PDL game...The clearing everything up part. Does anyone know what will happen next?


They will debit your account - And then you will have to file an affadavit and wait a few days to get your money back.

You are going to be filing a lot of those . . . . These companies don't just stop debiting your account. It's really better to put some sort of block on your account.

It's got some good solutions for properly blocking your account from these places.

It's really going to be a pain to have to file for every charge . . . .

I would also recommend sending them another letter revoking any voluntary wage assignment (wage garnishment) you may have agreed to under their contracts. Some of them send documents to the customer's payroll dept., stating that the customer agreed to a voluntary garnishment on the loan should they not repay according to the terms. This isn't a legal garnishment, but some payroll dept. employees don't know this and go ahead and process it. You might want to file something similar with your payroll dept., which states that you do not authorize any voluntary wage assignments.

Excellent advice so far. Have you over paid these loans according to the laws of Florida. Are there any others that you have besides the two that you mentioned. CashnetUSA is licensed in Florida from what I have read through an agreement with some pawn shop located in Florida. They have a dual personality whe it comes to collecting. You will get a nice person one day and a totally rude and obnoxious person the next. If you make an agreement with them get it in writing. I just wrote the president of the company because their people are so difficult to deal with.

i originally posted the question, then registered. I do have a few other internet loans, one will be paid off next payday and i have 2 others that will be paid off the following payday. I have overpaid on Cash Doctors and Cashnet USA, also Cashnet Usa loaned me $650, florida law states the max loaned can be $500. Off the top of my head, I can't say how much I've overpaid. I will look at my "Chart" and post it...

Please file a complaint with the FLDFS. They are supposedly the regulators of the PDLs in Florida and make sure you copy the CFO, Ms. Alex Sink. I live in Florida and other Floridians have been getting kind of a ho hum response from the people at the division. I am trying to get as many people as possible to file complaints so the state may possibly take a more aggressive stance against predetory lenders. A case was just decided last year in favor of a borrower against a internet lender here in the supreme court but for some reason it is not setting a precedent as it should.
