Indiana Laws - Staying out of Jail


I need help...I have 6 PDL's, one is store front and the others are all internet based that are not licensed in Indiana. I am getting phone calls telling my they are going to contact my employer and take my check and put a warrant out for my arrest!! Can any of this be true?


Relax, none of that is going to happen. You need to work out a repayment plan with the storefront payday loan company though, they will take you to civil court and get a judgement. As for the unlicensed internet payday loan companies, they are blowing smoke, don't worry about their threats, they are operating without a license and they are not in a position to have you arrested, YOU HAVE NOT COMMITED ANY CRIME. Get complaints into your AG's office ASAP.

No they cannot have you arrested, nor can they take your employment check. They are breaking the law by telling you that. They can only have your wages garnished, usually no more than 25% but that is only after they get a judgment in civil court.

Most PDL companies will not sue because they are in violation of the laws and would not be able to win in court, that is why they resort to those intimidation tactics. Don't worry you will not be arrested and they will not take your check.

How much are your loans for and with who and how much have you paid so far?

Most storefront payday loan companies do take the consumer to civil court and get a judgement if it is not repaid or a payment plan is not set up. They typcially follow the laws because they are licensed. You will find the occassional storefront collector making the illegal threats, but that can be found just about everywhere, there threats aren't as scary as the unlicensed internet payday loan company.

They are just full of hot air. Do not allow the Internet PDLs to get you upset. Just say thanks have a nice day and hang up. The more you talk to them the more you lead them on. Please tell us how much each loan was for and from which lender. Also, how much you have paid each one so far. That way we can help you determine what you legally owe.
You must close your checking account immediately so that you can breathe and deal with these companies on your terms, not theirs. Tell your payroll dept that you need to get a live paycheck for a while.

Take the advice given to you above. We have all been in this situation and some of us are still working through it! Close your checking account and open a new one and then make your payroll dept aware that anyone attempting to submit a VOLUNTARY wage assignment is doing so fraudulantly. If you feel uncomfortable telling them that you have taken out PDL's then simply tell them you have been a victim of ID theft. Best of luck to you!
