Asset Acceptance

These guys bought my account from NextCard Visa (they went Bankrupt, not usre if any of you know this story) Anyway, they've been harrasing me for the last year, and this last week I thought to myself that I'd really like to pay them and start over (repair my debt) but.....

Doing a search for them on the internet, I now see all these nightmare stories of how people paid and are still being hounded by this company, and how they are one of the worst collection agencies on the planet, which obviously has me thinking twice.

I don't know what to do? I ran up a debt of around $3000 with NextCard, and then it was bought off by another company and now it is in the hands of AA, who is stating that I now owe them $7000. Yesterday, I just pulled up my Credit History, and would like to share this debt with you guys to see what you think.

Date Reported
Date Last Activity
03/05
10/01

Date Opened
06/04

I'm not really sure what the above mean, but I've discoverd this thing called an SOL, and it's seems to be 6 years in New Jersey, where the debt took place. I really want to do the right thing here, and rebuild my credit (which is crap) but I can't afford to pay this company and them have them come after me later on down the road. From which date does this SOL take place? and how can I find out the original SOL (I heard stories of how these companies screw you with that also?

Thanks

The first step is to do a debt validation ( http://www.debtconsolidationcare.com/validation.html ) and see whether this debt is valid.

Try negotiating for a better payment plan and in most cases they will reduce the interest and late charges.

It takes the opening date, over here (Date Opened 06/04 ) , if the debt is older than SOL you can tell your creditor that they are wasting their time on it.

I just called Asset yesterday, and spoke with a senior debt collector. I told them that I wanted to settle and pay them. He was very mean, and when i asked that they send me an agreement letter in the mail hee told me that they don't do that. He said that all they could do is to fax me one, and that I'd have to pay by check by phone or credit card that day.

Is this a scam?
Legal?

When I mentioned that I've got rights with the fdcpa to him, he just hung up the phone on me.

I really want to settle my debt, but they're making it impossible.

Not true, it is a strong arm tatic they use to gain access to your accounts and payments.

as vikas said above, send them that debt validation letter to start with. They are obligated at the very least to detail what you owe, how they figured you owe that amount, the amount of fees, interest, etc you have been charged.

thanks! i though that it was kinda strange since they keep sending me lots of things by mail. why wouldn't they send me an agreement letter?

Anyways, I got myself a debt validation letter all printed up and ready to go, but am a bit hesitant cause I'm scared they might flip this around on me in some way to kinda screw me.

Somehow they say i owe them $7000 and they'll agree to $3500 only if I do it through the credit card by phone or check by phone, which i aint do ever.

I've actually heard of people getting sued immediately after sending this debt validation letter. Some other tactic they pull to scare you, but i obviously don't want that either.

I really just want to pay these people and get them out of my life so I can start building my credit again.

it's amazing how dirty this business can really be!
