collection agency garnish state taxes

this collection agency garnish two years of state taxes if i win the case do they have to return the collected money or is there court papers i need to file to recieve them

It is sometimes difficult to get a case out of the hands of the collection agency. They respond that they operate under tough, widely understood standards.

If you win, they are required to return the collected money. You can file court papers to receive if it becomes necessary.

Private creditors, federal and state governments can place a levy on your taxes. Federal and state governments need not have a court order, however private creditors or third parties need to have a court order. I would consider consolidating these loans and paying off the debt that you incurred to prevent from further actions.
