I have worked with Asset Acceptance
over the past 2 years I had bad credit from having a lot of credit cards and they have been growing interest rates sky high these debt collectors use to call my house and my job and my family until they lost contact with me because of me moving .but I just thought that it will go away until I want to move and the leasing dept took a look at my credit history and turned me down then I realize that I got those credit cards and use them and I changed jobs and lost one but was hopeing to find a job with good benefits and one that I would like to set up my retirement plan an I did and as soon as I stayed 2yrs Asset Acceptance called and we talked about my credit report .and they ask me do I want to clear up some of my bad credit and would I like to make a payment plan one that wont hurt my budget too much and I said yes lets give it a try so every 15th of the month they was aloud to take a fee out of my account which were I agreed to and they worked with me and now I am almost done paying off my bad credit and debt.as I was paying off my credit I was making sure that I got a statement in writting that the debt was paid and removed off my credit report and it feel so good to get some of that negative stuff off my report my credit score is still low but I can establish credit now. years ago my credit cards were taken out of my home,the people were convicted on racketeering in 5 states and went to jail, my life was threatened and my credit ruined .its been over 7 years and i told asset acceptance my cards were stolen but they keep harrassing me and my wife with annoying calls.my wife put us on a do not call list which they seem to ignor.when i told them they were stolen they asked if a police report had been filed.i told them no and i did not know credit card numbers or who to contact.
the police dept were this incident took place were providing protection for this gang of thugs and i knew they were getting paid to do it.i am not about to file anything with the local pd were it happened and want to forget everything i moved out of state and this asset acceptance is very ignorant to keep calling me.attempts have been made on my life and i want them to stop. any suggestions?

It must be somewhere that Asset acceptance must be calling you for some valid reason which you may have ignored or has not been stated clearly. Try to know the reason first for harassing you so badly and then if you think that you don't have any fault from our side, then take the help of attorney who will sue them.
It's very necessary to take any action as soon as possible otherwise you won't be able to prevent yourself from any untoward incidence taking place.

Asset acceptance specialize in debt acquisition. In other words, you may have taken out credit with one company. However, asset acceptance purchased that debt from that company. So now you are repaying asset acceptance instead of the company where your debt originated.
It is a business practice called accounts receivable. It doesn't affect your end. Through this transaction, Asset Acceptance became your new bill collectors. It is just a business to business transaction. Based on your surprised response to seeing it on your credit, I am assuming that this is what is going on. But just to make sure, contact asset acceptance to verify where that debt originated from.

It is actually not money anymore. The whole economy has shifted based on goods, commodity's and exchange , those kind of positive, solid objects, to where all economy is based on debt and debt only. If someone owes you, you own them, that's why you guys are all going to work everyday cause you owe somebody and they own you to that degree that's why you have to go. That's happening to everybody in the name of commerce. Now the whole schemer is the more debt you control the more you control everything.

asset acceptance llc must not have employees with common sense as they have call my residence twice a week for the past 2 months and have yet to realize that I do not care to do business with them. This nonsence that this is not a tele-marketing or solicitation call is a lie. Why else are these people calling. You can also contact your state Attorney General Consumer Protection Office to see what laws are prevalent in your state to safeguard your interest. These calls should stop and you can take your legal step by issuing a written notice to them stating that you are not interested in keeping any modes of communication with them. Inform them that you are tape recording all the verbal communication and will be filing a case against them.

the call is placed to my home number from 1-866-608-0400. it is always a voicemessage, even when i pick up. i finally called tonight and was harrassed about an alleged debt of under $100 for Blair Company. what disturbs me most is that the woman on the phone said that to prove that debt is mine she would give me my social security number - and promptly rattled off the last four numbers. she wouldn't transfer me to her supervisor.
i am concerned about identity theft - especially in light of recent events concerning credit card info being hacked into.
what is more interesting is that this or a similar company has called my work phone number. when i got someone on the phone who had some savy, we discovered they were looking for a former employee who must have left at least six years ago but used this number as a contact one. and i work for a municipal government agency.

You can contact the fraud department of each of the credit bureaus and ask them to flag your credit file for fraud. You can use your cell phone number so that the creditors can get in touch with you easily.
Once a fraud alert is activated, the three credit bureaus will share data within themselves.
All the credit and insurance companies will remove your name for any offers for a period of 2 years.
Each of the credit bureaus will send you a credit report within 14 days.
The fraud alert will be there in your credit report for a period of 3 months (Experian), 6 months (Equifax), and 12 months (TransUnion).

Asset called this week and asked for me by an old name of mine. They said they had a record of a 10+ year old old debt that I do not recognize. They read me a social security number. It's very creepy. I called the credit agencies and put a fraud alert on my account. Should I be calling my bank, too? Someone else?

It seems that Asset Acceptance is trying to recover a past debt from that person who stole your identity with the help of your previous SSN#
Talk to them and inform about your situation. If they insist, ask them to send their claim in writing. Later, you can send a copy of your identity theft and other necessary papers that can prove your part. Make sure that you send the correspondence in writing through certified mail with return receipt requested. This way you will be able to keep a record of everything.
Have you received a new SSN# from the social security department? Also, did you inform the fraud department of the three bureaus and put a check on your credit file? There are ways to deal with your stolen identity. I hope that you will take necessary actions to prevent your identity from being misused.

I am so glad that I came across your forum here. I received a call from these people using a former name I haven't had in over 15 years. Since reading all of your comments I will immediately proceed to put a fraud alert on my bank accounts and credit cards and contact the credit bureau. :x I received no written notification about any debt. My ex-husband is dead so I know that this is fraud.

You should ask Asset Acceptance to give you the debt validation of the said accounts. The accounts mentioned seem to have past the SOL period and 7 years reporting time as per the FCRA laws in anyway. So, you are not required to pay this debt at all.
Before putting a fraud alert, first check your credit report and see if the agency has hit your file negatively or not. If they haven't, do not activate this alert. Handle them manually by asking for debt validation and send a cease and desist letter.
As per the fdcpa laws, the company is required to stop all collection efforts after receiving your letter. If they try to contact you, it will be violation of the federal laws and you are in charge of taking legal actions against them.
If the calls placed to you are regular, you can start recording them even. List the names with dates and time on it. This will make your legal charge stronger.

Then lately I received a phone call asking me to call back 866-801-0004 (allied interstate) and give them a reference #. After finally deciding to call 866-801-0004 today, the woman on the line told me I would have to call another # 800-833-5313 because she could not open my file.
These calls are extremely annoying; not to mention from the research I've done - it sounds like these calls are from a collection agency. I don't even owe any money...except for the fact that several years back I had a fraud alert to the credit agencies for cell phones that were purchased in my name (not mine). One is still on one of my credit reports...I'm working on getting it taken off.

I keep getting voice recorded messages from 866-608-0400, over and over. I told them they have the wrong person and wrong phone number and they continue to call me. I have spoken with Katy and Holly who assured me my number would be removed from their system but I am still getting calls. Inform the caller that you wish to present these details to your lawyer and file charges against them. The legal actions will keep them in the best of their behavior.

Asset Acceptance is one of the worst collection agencies in the industry. Make sure that you are completely alert before making any agreement with them.
This company might be calling you for one of your past debt. Ask them to verify the account they have with your name, address and SSN#. Don't give anything from your side in the first place. Let them say it for you. Once you have received this call, you are supposed to get the details of this account in writing as well. After they have verified your name correctly, tell them that you will like to see the details in writing.
The fdcpa law protects your consumer rights and you can refuse to pay the debt before it has been validated. After you have seen the details, if you find anything that is incorrect, you can place the item on dispute with the company. The company will verify it with your original lenders and then give you the corrected details of the account.
Check the state laws and see if this account is within the SOL period. If the debt is out of the statute of limitations, you can't be entered into a lawsuit and also, refuse to pay the debt legally.
Ask the company to do all the future communications in writing only. You don't want to be called at your home or work. If they are not keeping your request, you can write a legal cease and desist letter to stop further communication with you except by mail. This will protect you from any harassing phone calls in the future.
Do not fear while talking to them. Be confident and be aware of your consumer rights. You will be able to handle this collection agency very efficiently if you are aware of your rights. Do all your correspondences through certified mail with return receipt requested. You will have a proof of all your actions taken. If you have any problems, feel free to post it here.

They filled a suit against me in Broward County for a credit card debt that is not mine. The Judge ordered them to prove the validity of the debt and that it was mine. 6 months later, no proof, but a sudden barrage of Motions and requests for evidence to prove their claim from me. I refused to answer and they continued to file motion after motion ALL of which are granted by the court before I am given the oppurtunity to object. However, when I filed a motion to dismiss for their failure to prove my responisibility, I had to ask the court repeatedly to hear my motion. Today, the Judge dismissed my motion and told them they could go to trial if they felt they had the proof. They do not. And I was advised by the court that I must wait until they decide what they want to do and that I would either hear from them or I would'nt. I feel that this will continue to hang over me and I will have to keep on top of it to make sure I do not miss answering any of their motions to avoid a default judgement in their favor. Hardly seems right, and I was told by the Judge that the FCRA does not apply once the case has been filed. Seems the Attorney for Asset Acceptance spends most of her time in the same Judges courtroom and is freindly with both the Judge and the Clerk. Not sure what step to take next, but it appears that hiring an attorny to beat them at their game over a 5 year old debt (statute has expired, and it is not my debt) to make this go away. All over $1500.00......

Did the CA try to contact you over this matter before filing the case at the very beginning? It was very necessary for you to dispute with them at that point so that you would have been able to prove your side of the story to the judge. Your letters of dispute would have definitely worked here. Your refusal to answer made them stronger like wild elephant. And now, your options to defy are becoming very tiny. Take help of your lawyer to see if situation can be turned towards your favor.

After that, one auto payment after I cancelled was taken from my bank account or credit card that I gave them at sign up. I went into the Ballys and complained and was given a cash refund for the unauthorized debit. This was Nov 2001. I heard nothing more about the Ballys membership until June of 2005 when this Asset place started sending me letters. At that time I looked at my credit report and found Ballys had reported only on my Trans Union report, I filed for an investigation and it was subsequently removed becaues they could not verify the debt. Since then it has managed to appear on the other two credit agency reports. Asset will not accept the letter from Trans Union stating it was an unverifiable debt that was removed from my report because "they use experian".
I'm at a loss for what to do. I followed the specific instructions on the back of the contract to cancel the membership. The gym accepted this cancellation. I was in their computer as a former member when I went in and complained about the unauthorized debt (meaning I didn't come up as an active member). I literally heard nothing for years. Now I'm getting collection bills for twice the amount of the original contract and this Asset place is claiming I signed another contract. Well I say produce it! I spoke with them once, got yelled at that I was a piece of white trash who wouldn't pay bills, that I was a liar and a thief, and incapable of taking responsibility for my financial decisions etc. Then hung up on. I called back 20 minutes later after I had calmed down some and spoke with a woman who refused to transfer me to a superviser, told me I was lying about the contract, and told me she was "moving on" and hung up on me. I called back immediately and requested a branch manager. She was polite and said she would look into it and call me back. Someone else called me back to tell me today (the next day) that they had forwarded my account to legal. But no one can tell me what that means. So I called back once more and the woman said if I faxed a copy of the letter I used to cancel the membership by Monday she would hold the legal off until Wednesday.
What am I supposed to do? I have the letter and will willingly fax them a copy, but I really doubt it will do any good. I also called the club I signed up at earlier today to find that the man who sold me the membership doesn't work there any longer. I tried to call Ballys Corporate and got a bunch of changed numbers.

You must have the clear and exact picture of the debt that Asset is bringing in front of you. After calling you up, they are required to send you the details in writing. It should be sent within 5 days after giving the first call. If you haven't received anything, write a letter to them request the debt validation. It's a federal law that legally forces the collection agency to give you all the necessary details about the accounts that you owe to your original creditors. Once the CA has received this letter, they can't make any phone calls or attempt collections till the debt details have not been given to you. After getting the itemized detail, verify it very thoroughly and see if the amount shown is correct or not. BTW, did you receive a cancellation in writing from Bally's? This will prove that the charges shown in the debt account after cancellation is baseless.
Your first move is to ask for validation of the debt from Asset Acceptance. Send this letter through certified mail with return receipt requested. This is very important because it will ensure not only its delivery to the company but also you will be able to prove your responsibility and actions taken to resolve the matter.
After the validation request is given to you, if you find the debt shown is incorrect, you can dispute with the item posted incorrectly. The CA will get it verified with Bally's before they further collect anything from you.

I would mail this request for validation letter to them, but it would not arrive before Wednesday when my account is being forwarded for legal action. Won't it be too late at that point? Should I just get lawyer? I don't really want this to be some long drawn out process. I'm trying to buy a home and this is the only bad thing on my credit. The fact remains that I cancelled the membership according to the contract and I will not pay any amount regardless if it drops 50% and matches up with the original price of membership. I can't belive that this company can buy an invalid debt that is over 5yrs old and treat innocent people this way in trying to collect it!

It doesn't say anything in the contract about recieving confirmation of cancellation of membership. It just outlines how to cancel and then states that any refunds deemed necessary will be returned within 30 days. Since my fee for joining was non refundable I didn't have any refund coming to me. Except for that unauthorized debit that they gave me cash for at the club.

Asset Acceptance won't take any legal actions with which they always threaten. They have lots of cases against them and they have fear of taking any matter to the court. They just try for someone who will pay them hurriedly.
Make your basis covered by sending the debt validation letter. Send it certified with the return receipt requested. Even if they don't pick the letter, you have your defense proving that you tried to resolve the matter but the company failed to honor your request.

The contract I signed stated that I had 10 days to cancel the membership and that to cancel I needed to provide a written letter stating that I was canceling and why to the gym at which I signed the contract. If I could not hand deliver the letter I could send it to the following address... which is the address of the club I signed up at. So I hand delivered it. The man who sold me the membership took me into his office, read the letter, made a note on it and said that everything looked to be in order and asked me several times if i would reconsider. He offered me cheaper rates, guest passes, membership upgrades etc. I said no and he said alright, I will cancell the membership. I didn't ask for anything in writing from him because I had no reason to believe he wouldn't cancel it. After the unauthorized debit came through my account I went and talked to him and he gave me my money back and apologized. He looked in the computer and showed me that I wasn't an active member and he had cancelled the membership. He was very understanding and said that because I had set up an auto debit it had gone through before the cancelation was final and that it would not happen again. And, it did not happen again. I had no reason to believe that the membership hadn't been cancelled. I had that same account until I moved back to VT in 2003 and never saw another cent given to Bally.

I will request you to send a letter to Bally's and explain them the situation that you are being contacted by a collection agency for this account in spite of the account being closed. You can request them to verify it in their system since it must be there even now. After they have reviewed it, request them to send a letter in writing with the date the account was cancelled. If they can send this letter with that date when the account was closed, and then you compare it with the dates sent by the collection agency, things will be clear in front of all. The dates will prove that the charges occurred irrelevantly even after the account has been closed.
Meanwhile, ask Asset to give you the details of the debt in writing. Do not make any payment agreement with them for the time being. I can understand what you are going through. Surprises come this way only never knocking at the door!

The experience ihatebally is having is the exact reason I will not buy a gym membership unless I can pay for a full 6 months to a year. I had a gym membership one time(not with bally's), and they took the membership fee out of my checking account every month. Then I decided to cancel...according to the contract you had to give 30 notice, so I did. They withdrew money every month, for a long time. I kept calling them and they kept saying they would take care of it. They had taken over $500 out of my account before I finally got fed up and faxed them a letter stating they had 10 days to return my money or I was getting a lawyer. They returned my money within the 10 days. But I will never go through that again. I have heard of other people having that same experience with various gyms. I don't know what it is about gyms that make them do that. Although they did not continue taking money from your account, they still kinda did the same thing by continuing to charge you. Seems impossible to cancel a gym membership, and makes more and more people afraid to get one.

Most of the problems occur when people fail to get a written cancellation statement from the gyms. If there is a paper that can prove the cancellation, the company contacting with some past debt can be proven wrong with the help of this paper.
Everyone must make sure that if you sign a contract in paper and mark the beginning, then you must also get a written statement to confirm the end of it. If you cancel in the middle, there must be a paper to prove that you have stopped using the services and as a result, not obliged to further charges unless specified.
