Canceled account of Evergreen Professional Services - Update


Had recieved letters and a few phone calls from Evergreen Professional Services a while back.
They stated that I owed a certain amount to an old, closed account(USBank checking).

I sent their letter back to then, requesting that they verify the claim they were making. I also stated that they were involving me in fraudulent activities and I wanted NO part of it. Said I could provide proof, which I can, as long as I don't lose the website address!

Both parties called once after that, but no message left, as answering machine and phone ringer turned OFF, so I'm not interupted by unnecessary phone calls late at night - 8AM to 5PM. I work nights, so I sleep all day!! Have not heard anything more from either party since then.

About a week later, I recieved a generic form letter, stating my dispute had been recieved and they would get the necessary information from original creditor and send it within 30 days.

Within a week of getting that letter, I recieved a letter with formal comapny leter head, stating that the account was being canceled and if I had any questions, I was to call them.

Can I send a letter, requesting a written explaination of the actions they took, and why??

This company contacted me regarding a debt which I believed to have been resolved several years ago. I have requested documentation from them since I had just learned that the debt existed and they have been difficult and arguementative. Do I not have the right to more information than I xerox letter stating debt owed. And this company claims they are not a debt recovery and that they have always held the contract on me. This was a bally's gym account and I have never heard of them before. Do you have any info on this company? I have no problem trying to resolve this debt but with proper information. :oops:

Welcome to the forums. You are correct in your approach by asking for proper information from your debt collection agency.

Under the Federal law, you have the right to acquire information of your accounts through the debt validation weapon. This legally forces the collectors to put valid information on all the accounts that they claim. For a deeper idea, please look into the debt validation page in this site.

If you read the above post of Keith, you will find your case similar. So, there are possibilities that through proper moves, you can avoid these unnecessary problems.

Please pull your latest credit report also as it will provide updated information on all the accounts. It will be helpful and you will be more accurate in your further moves.

Recieved a reply to day, from Evergreen Professional, regarding the canceled account.
They simply stated that they had to cancel the account in question, because US Bank was not able to validate the claim.

Been almost 10 days, no reply recieved from ERSolutions.
Not even an acknowledgement that my dispute letter has been recieved. Send another, or attempt to keep waiting for an answer??

When they say they have always maintained contact with you...that could also be by mail. If a company mails more than one letter out to you and it doesn't get returned, they're going to assume that they are getting to the right place.

The only way you could actually prove that you were at another address is either by your credit report (they go back about 10 years) and bills/driver license/etc.

Be sure to keep documents of anyone you speak with.

Never give out your address willingly, unless you know this is a debt that is yours. The post office can do what's called a "General Delivery" for you if you wish to remain private. It'd be the post office close to you, and they can hold you mail for a month.

So it would be

Your Name
General Delivery
City, State 12345

that way, after you go back to your regular address the collectors will never know your real address. By them knowing your real address, they can attach this to your credit report. There could be 3 Connie Smiths in NYC...they found 2. They think this is the correct one. This is how most companies make their mistake, thinking that Connie Smith #2 is actually the #3 they're looking for.
