I have a medical bill that is over 6 yrs old. Collection agency keeps calling and say they can call me daily until I pay. I'm in TX and statute is 4 yrs. They tell me medical bills don't fall under and statute of limitations.

Please help - i have no idea what is true.

Please be very careful while dealing with your collection agency. They are in the act of violating the fdcpa law in the following ways.

They threaten you of calling endlessly which is a violation of the Fair Debt Collection Practices Act. Please inform them that they are violating the law and they need to stop further communication. If they continue, you have the right to take legal action against them.

They say that there is no Statute of Limitation on medical bills which is again a false statement. Statute of Limitation applies on all the unsecured debt and it includes -


  • medical bills
  • credit cards
  • department store cards
  • personal loans
  • student loans
  • bounced checks


As the statute of limitation for legally collecting the debt has expired, they should not involve in illegal activates for recovering the debt. They cannot force you to pay money over a debt whose SOL has expired.

Make sure that you take action against such unfair activities by writing a notice to them and explaining your cause. Your letter should be through certified mail and return copy requested. There is nothing to worry from your end.
