Explain that one! With the signature of an offical police officer, AG and Detective, you tell me how the paperwork is fraudulant? I'm not missing the point, everyone has a right to their opinion! Let me tell you something. I'm not crying "woe is me". We had $2000.00 stolen out of our checking account and have had trouble bouncing back. Have you ever had this happen? If you ever do, lets see how fast you bounce back, and how well the creditors work with you.

I have never had my bank account raided, and I am glad it wasn't me because $2000 would have been the least of my worries! Now, as far as fraudulent papers, I could send you some. I get them all the time from people who think we will never check up on it. I do admit, however, that most agencies will not take the time we do to verify this kind of information. I don't want people to think I am protecting every collector or agency out there, I could never do that. The jokers from Crosby Ellis made sure of that. There are bad apples out there, but overall it is not the picture painted by some of you. I simply defend the general image of collecors and agencies.
BTW- I have never defaulted on an account, ever. I pride myself in that. I have had some seriously hard times (Law School at night while working a dead-end deli job) where it would have been far easier to default on some of my debt. I never did it. I did without to get where I am and now I am reaping the benefits. It isn't a miracle, anyone with a grain of self control could do it.

You are doing the same thing what annoys you. You are also generalizing all the debtors and attaching the stigma of 'escapist' on them. How could you know that I am not a regular payer?
If I am passing through a tough time, that is completely my fate (and mistakes, sometimes). I have to pay my bills; nobody will do that for me.
I have asked to one of the rep from collection industry in this forum that how would you justify the harassing collection calls to an elderly lady, who is an Alzheimer's patient and lost her everything in Katrina? The collector replied, if she had lost everything then how she was contacted by the collection agent?
Do you train your employees this way?
One more thing, why don't the collection people transfer the call to the supervisor. To avoid a heavy download, lol, or they might miss their day's incentive? Why do people call six times a day when I inform them I have no idea about the person they are looking for? Why they do not want to disclose their address and contact number, just continue asking for money, money, money? Who will answer to these questions...silence?

Consumer Y, I don't generalize debtors, just the ones who set out with bad intentions. I train my collectors to be helpful and to get the debt resolved, even if resolution means 12 month arrangements. We put a 3 month hold on all accounts in the affected areas of Katrina VOLUNTARILY. We also have a hardship program to help victims of the disaster in paying their debts. We are not predators, we understand life sometimes throws you a curve of massive proportions. I am not without compassion.

i was just recently contacted and threatened by this company that because i defaulted on my childs instrument payment that something about theft by conversion would be charged against me,i was told that in the contract that it was a felony in the state of fla. is this true and what can i do?

I was only their for less than 2 days...I thought I was in a daycare center,they have thier 2 children running wild throughout the collection floor,the owner seemed to be in a drug induced coma,found out later that the owner had been arrested along with his wife at the business in front of all of their employees and the police have been called multiple times, as well as, now a police sub-station has been put in the same building as them. If you don't believe this contact the Jacksonville Sherrif's office.
Moreover, it turns out after having a discussion with someone that worked there for a number of years.. this person states that drugs in the form of cocaine are done frequently and sold frequently on the premesis. THIS I COULDN'T BELIEVE!!
So, as you can see the man has two businesses and one clearly appears more profitable than the other.
Now , as far as , Ellis Crosby... all of his employees came from Allan Lewis and most are convicted felons.

I left on my own accord. Once I realized I was working with a bunch of criminals who bragged about their own felony charges while on the collection floor. These same employees would continue to brag that the owner (collector x) would bail them out, meanwhile alow them to work off bail in the form of payroll deduction.
On top of that , in a short period of two days .. I did in fact witness employees snorting cocaine on the premises when I would confront they justified themselves by stating the owner does coke and it's accepted here, as long as , your collecting enough fee to justify your existence and subsequently justify the habit.
Coming soon real names with real phone numbers .. of these people who have frightened debtors to pay... at this daycare/homeless shelter full of druggies and convicts.

I'm trying to be neutral on this one regarding Collector X. He speaks of commitment to the fdcpa, but not of thoroughly understanding how truly tough some people have it. Collector X sounds like a cut-and-dry black-and-white no-ifs-ands-or-buts businessman who thinks in absolutes. That can be construed as heartless of course. Collection managers are trained to think in absolutes regarding all debtors, so therefore he probably does not hear "hardship" or "lost job" or "someone raided my checkbook", he hears either "agree to the terms" or "refusal to pay". That's how collection managers are. I have one breathing down my neck all day long about meeting my monthly quota, working all my accounts, and all that fun stuff. I hear things from people that are just dreadful, and I feel sick to my stomach as I do as I'm told and continue to push for postdates. I'm currently seeking an avenue (new job) out of collecting payday loans because I am experiencing a crisis of conscience. As far as I believe Collector X is concerned, it's just business.

I set up payment plans with this company provided they send me in writing the breakdown of what I owe them. I of course never heard from them again.
This morning Saturday Jan 7th my Mother received a call at 8:00am demanding money from them. She told them I did not live there and had not lived ther for over 20 years and they began harassing her about paying the debt for me and telling her that they were going to put her daughter in jail.
She took their number off the caller ID and my dad called them back. He told them he was going to sue them for harassment of a bill that was not theirs and they hung on him.
I am mailing a cease and desist letter today and my brothers wife who is a DA in Illinois is now going to start looking into them.

Federal law forces the collection agencies to put the accurate picture of this debt in writing when they made the initial communication. Dispute with them on this account through a certified mail. You will cover your legal grounds in disputing with the company and will be able to defend yourself if the matter is taken to the court. Since it is not your debt, their is nothing to worry even if they take you to the court. Some companies try to scare people in order to recover money from them by any means. I am sad that you are getting the calls from them.
From next time, don't even make any payment agreements unless you have seen the details of the debt in writing. Suppose if you don't owe anything to the company, but since you agree to pay them after seeing the details, they will prove that you are trying to escape from paying the debt. Companies doing fraudulent activities don't need much time to create stories and scam people. Be careful at every step!

So, I've been "dealing" with this company for a while now. They hang up on you if you don't say you'll pay them, they don't listen to the original companies the debts were held by, and they threaten with empty words.
I called the store that claimed I had the debt. They confirmed my payment, and confirmed that they had called TWICE after my complaints to AL&A, and would call a third time today. AL&A are getting people's money even when the debt is paid...so where does the money go? Into their pockets? Who knows?
I've contacted my state's Attorney General's office with proof of their mishandling of accounts.
I've contacted the BBB with the same.
I've also contacted Bud Hibbs' website over this matter.
I have recorded proof of them claiming to be a law office, names of employees, documented attempts to get this claim removed from their office by the company originally filing, and recorded proof of their inability to handle legitimate claims of innocence, even when faced with proof.
Your best bet in dealing with these "bottom-feeders" as Bud calls them, is to beat them at their own game. Call their bluff. Get an attorney, have all the documentation you need, record conversations, save voicemails, get names. Then, when they threaten you, tell them to go for it. If they report a fraudlent claim to your credit report, you can file proof of payment - preferably payment dated before their claim - and take it to your lawyer. If they threaten to arrest you, call your lawyer immediately, play the recorded conversation, and have them contact the local law enforcement immediately. If they're threatening you on something that is paid - and you can get proof (bank records, receipts, signed testimony of the people working at the debted office, etc.) get that all to your lawyer before anything can happen so that person can be well-informed and prepared for your case. You may have enough for a lawsuit.
If we all get together, the company may have enough against them to shut them down - permanently.
They are claiming to be a law office. That in itself is illegal. False representation is a big term for identity theft.
If our lovely collector Mr. X is reading, know that not all the people getting harassed by this company are "half-wits," as you called us earlier. AND, we have paid our debts - it's this company that won't let go without getting the money for themselves. The debts have in some cases been paid to the original company, and that company has documented efforts to get the accounts removed from this office. If they aren't removed, legal action can and will be taken for misrepresentation, fraud, telephone harassment, and maybe if we're lucky, embezzlement for the money received for accounts previously paid.

To all legitimate people with issues concerning this office: Please don't let Mr. X and his limited social skills fool you. I'm willing to bet he's Mr. Cameron Poe from AL&A, the person who called me, leaving a message that ended with "good luck." I'ts certainly my lucky day, as I'm finding more and more ammunition to bring this crew of demented liars down. Please call or write to your attorney, Mr. Bud Higgs, your local and the FL Attorney General's offices, the BBB and maybe even your congressmen if they are active in their constituents' rights being violated. The more high-up people that know who to look for, the better. Keep all correspondence, keep all records of calls: names, dates, times, and preferably recordings. They are recording, you can too. Keep all voicemail and answering machine messages as well - people tend to be more brazen when they aren't talking to a live person.
Keep your chins up, you're good people that deserve all the help you can get. Don't let people like Mr. X get you down. Being able to ignore someone is God's greatest gift to us. Just like bullies in school: if you ignore them, they lose their audience and their reason to do what they do.

The "stigma" you complain about surrounding the collections industry is earned on behalf of the entire industry by the minority who either do not understand the state and Federal laws they are dealing with (many state laws are far stricter than federal). Or they do understand them but have decided the promise of a quick payoff far outweighs the threat of fines or prosecution for violation. It is earned by the use of threats and mis representation. It is earned by agencies that add exorbitant fees to debts, just to line their account, even when state laws do not allow for this. it is earned by agencies they refuse to validate debts. it is earned by agencies the refuser to actually talk to people and prefer to just turn their auto dialers loose. I can go o, but I think you get the point i am making.
Please notice I did not say all collection agencies or collectors were like this, but a high visibility minority.
IF you are operating within the confines of the law, then you have nothing to worry about when you have to review tapes to see what was actually said. Here is something I notices, how come when ever i request a copy of the tape, that call, mysteriously wasn't recorded? But some how I think if I were to file a complaint of some kind they would manage to find a recording?
If a debtor files a BBB complaint that does not always remain a negative remark on your file, unless you fail to respond at all. My experience has show even the most half hearted effort to address a consumer complaint with the BBB will build or maintain satisfactory rating with them. The BBB is very much biased towards the business, and really is not in favor of the consumer at all. Once again this is from personal experience, and is the reason why I seldom file complaints with the BBB as it is (in my opinion) a waste of time.
Yes, your record will show a complaint was filed, but if you actually make any effort at all to address it, it will also show that, if you don't make an effort, that will be reflected, and your rating will be affected. Please be clear on your facts before making declaratory posts in the future.
This forum has been very fortunate to have members from the collection industry (Past and present) who have helped to educate people to understand what their legal rights are, and provide tips and feedback on how to deal with collections agencies in a way the addresses and clears up the debt. I have never seen, and I do not advocate, using the laws as a means to escape your debt. About the only thing that maybe could bee seen as that from the collectors point of view is advocating community members to get all valid information and breakdown of what they are paying on their debts before making arrangements to pay it. Some states (Illinois being one) does not allow collection agencies to add to the debt, but many agencies will do that in the hopes the consumer doesn't 't know and blindly pays.
OH before I close there is one other despicable practice that helps to give the collections industry a stigma. That would be the purchasing of out of date debts, sometimes as much as 20 years old and harassing people to collect on debts they are no longer legally responsible for. In these cases the original creditor already has taken the tax write off for bad debt,( which consequently counter acts any true loss they may have had) ad this point this is just extra money. Why should any collection agency be able to collect on time barred debt? Why should they be able to demand full payment of a debt a consumer is no longer legally responsible for? They took the gable to by the debt at extreme mark down (2 to 3 cents on the dollar) No one forced them to, and they knew they had no legal recourse to collect it in the first place. It was a gamble and the industry should not be rewarded for taking such gambles. I pity the uneducated and uninformed who panic and fall prey to such practices and could do more damage to their credit by paying than by not paying it.
And for irritated Debt Holder, if More CA's would Actually WORK WITH consumer to make arrangements, they would probably recover more debt. But the hard nose all or nothing attitude is why they are not recovering more. Not to mention they are too quick to report to the CRA's.. Once you report me , what exactly is my motivation to pay now? Why not pay my current creditors who are operate ethically and within the law first and let the hard nose bill collector wait? The damage is already done, unless they want to offer an enticement, like removal of all bad marks.
Yes. the FCRA says negative reports MAY remain on your report (doesn't mean they have to ) and the reporting party can remove them at any time. that should be a big DUH, but the collections industry doesn't seem to get that one.

I remember Collector X very well. Although my sympathies lie with the forum members here who are giving it all they have to make it in life, I did share many of his points of view, after all, I have been there myself.
Collector X did not strike me as just another disgruntled collector trashing the forum, he struck me as a business man working in defense of other businessmen who need all their receivable accounts collected so they can get by too. I did not see a bad person in Collector X, he had very strong convictions of right and wrong, but his delivery missed the mark in this forum.

I had a very unprofessional experience with them. The call me out of nowhere saying I owe $800+ to some music company for a supposed rental almost 10years ago. Then I asked for something in writing the man refused and said I needed to give him money now. I hung up and had a friend call stating to be my attorney called and left a message on the general line and they never called him back. 2months later the same rude gentleman called me again. I thought it was a fraud call since this supposed "Law Firm" calls on a restricted line.

My mother, who lives in Montana, received a call from William Blair of Allen Lewis & Associates, stating that it was urgent he reach my EX-WIFE, who lives in Indiana, re my ex-stepdaughter. My mother called me in California and gave me his name and number, so I called him. He began by introducing himself as an attorney. He then stated that my ex is in SERIOUS trouble and he needs to contact her immediately! Concerned for my daughter's safety, I inquired as to what this is all about. He said that Federal law forbids him from disclosing any information to me, as we are no longer married, but said that it is VERY SERIOUS!!! I asked him how serious, and he replied, "This is SO SERIOUS, you will likely get custody of your daughter over this!" This concerned me, so I began doing some research. I called back the number I was given and asked the operator what type of office it was. I was told it was a "PROCESSING FIRM". That was all the information she would give me. Having this "PROCESSING FIRM"s name, I was able to pull up the company website and find that they have a history of shaky collection practices. I don't even know how they obtained my parents phone number, as they have recently moved and changed their phone number since the last time I even spoke to my ex. She does not use my last name, so their should be no connection to my parents. The phone calls have stopped for now, but how can I be sure they will not resume??? We have been divorced for many years, and there should be no connection between her debts and me. I was tempted to give Mr. Blair her address and phone number, but after reading about the illegal collection actions and Mr. Blair's missrepresentations of being an attorney and the seriousness of this matter, I am leary about doing so. Any comments or suggestions???

They are not attorney's and they are always threatening people with arrest and taking their kids away which obviously they cannot do. They claimed i owed money on a PDL which I do not and they called my mom and dad, my parents told them they need to talk to me about it not them. They also talked to my wife and tried to scare her also.

You can find a sample letter in the DIY sections of the forum. Please send it certified mail with return receipt requested. This way you will have proof that they received the letter. The debt is not yours so you shouldn't be bothered over it. Also file a complaint with the Florida AG and the fdcpa for impersonating a lawyer. That is against the law.

A Derick Alexander called me for the second time in two months and said that if i did not pay a debt that they (his company and lawyers) were going to press criminal charges against me and that I was harboring the property. If anything this amount, disputed, is a small claims court case, in which I asked them to file.....called and spoke to a supervisor names Sheryl and once I told her that i was going to file a complaint she said "I'm now going to terminate this call" because i was going to file a complaint.
