But the payments will be kept current, the house payment will be done on a conduit, which basically means they will pay your monthly mortgage for you as a part of the payment plan, and same goes for the car payment. Chpt. 13 is just a reorganization of your debt, Chpt. 7 is where you could potentially lose your home and car.

Filing Chapter 13 is much better than Chapter 7...That's if you wanna keep anything. It helped my house from getting foreclosed on. (Husband was laid off) My car payment was current. It didn't effect the length of my bankruptcy at all. I was actually glad they paid it on conduit, one less worry for me each month, and I knew my debt was being taken care of. The payment included my monthly mortgage plus an additional $350 to go towards my debt.

Chapter 13 is for debt consolidation so that you can catch up on
Chapter 13 is for debt consolidation so that you can catch up on your debts.
In this person's case, and I hate to say it, you may want to consider filing seven instead of 13. Seven is straight bankruptcy or financial freedom. I don't recommend bankruptcy unless it is in dire circumstances. In your case, they may be dire enough.
I hate the fact that it will be on your credit report for the next 10 years. I hate recommending bankruptcy to anyone as you have deal with high interest rates, inability to get loans and or credit cards, etc. Please think wisely before you decide to file. If you have already made up your mind that you have no other alternative, then please consider filing seven.
Remember, you cannot put student loans on a bankruptcy and you may have to show proof that you have attempted to work out arrangements to make payments before you can actually file.

Thanks a bunch Alexandra. I was talking to someone in my office who is filing a 7 and she suggested the same thing. My only problem is paying the fee. She has to have $545 when she files and the other 1/2 before she goes to court. I don't feel like I can do that, and I really do want to pay the people I owe.
