Zwicker & Associates Question
I have a debt for Bally's Fitness that was given to the collection agency Zwicker & Associates. We were paying monthly for a $600 balance, and in April we hit financial trouble and weren't able to pay. Our balance is $400.
I got a call from today, they said "the Attornies of Zwicker & Associates". They said they have to have a payment by the end of the month, or the whole balance is due and there would be legal action.
Is this true? I agreed to $100 next Friday, I really can't afford it, and I have to do it by Western Union.

I would suggest that you make arrangements to repay the debt. Only commit to pay what you can actually afford. Even if you promise to send them $25 a month, it is better than nothing. If you commit to send more than you can afford and then do not send it, it will reflect poorly on you.
Document all of their calls and if they insult you or try to intimidate or threaten you, keep a record of it. My attorney said with this documentation you can take THEM to court and file legal action against them. It happens quite often.
They can take you to court to recoup the monies owed. HOWEVER, this is a very long process and you if you have been successfully been making promised payments to them the judge will rule in your favor as you are repaying your debt.
Do not be intimidated by them. If they tell you that $25 is not enough, they are not being truthful. You need to start paying what YOU can afford so that you do not fall further behind. I was told that I could not make payments while dealing with them. This was a tactic to collect the total amount due at once. Truth is, you can make payments. Another lie that will get them in trouble should YOU take them to court.
My advise, pay as much as you can afford to and document, document, document. You have the law on your side...not zwickers or the people they hire to make calls. These employess are NOT lawyers. They are just paid hourly to make collection calls.

I sucessfully paid AMX for years until my husband filed for divorce and refused to assist with the monthly payment. The debt is $32,000 and Zwicker & Associates have filed suit in Texas. I've been paying a smaller amount through a debt recovery program for nearly a year. I live in Texas and will have to respond to the suit quickly. Any suggestions?

I take it from your post that you are making regular payments through debt recovery program. Can you mention the agency to which you are making payments? Is it Zwicker & Associates or is it AMX?
I guess you should talk to the counselor who is involved in your program. No creditor or even the CA will file a suit as long as they are receiving the payments. They might insist to alter the plan and the consultant should take proper care of it through negotiations.
I finally assume that either Zwicker & Associates is filing this lawsuit on false charges or the debt recovery program has not been making the monthly payments.
Talk to the consultant and get into the depth of this matter.

The collector must have a license in your state before they attempt any collections on you. Besides, the CA is required to give you the details of the debt in writing. The debt validation letters asks for the details of the creditor for which they are collecting along with calculations of principal amount and the interests added on it. You can refuse to pay the account till these details have been given to you in writing. Send your request through certified mail with return receipt requested for records. I know wages cannot be garnished in Texas but you must check with the attorney general of your state for accurate information.

A comapny can not threaten legal acton unless they are actualy planning on taking said action. It is illegal to make idle threats.
When you signed up for Bally's there in the fine print said that if yuo default they can call for the entire balence in full. Most collections agencies wil work with you provided you agree to their terms. They have to report any payments sent to any acct.
Zwicker & Associates judgment
My post is similar to Morgan's. I've had an AMX card for over 15 yrs and faithfully made regular payments & paid balances off. I've gone through several layoffs over the past 4 years. I'm now without a job, my home is going into foreclosure and I'm broke. I called AMX routinely to update them on my status and explain my circumstances. My AMX balance is around $27K. AMX said they'd work with me and to keep them updated. I still paid AMX as much as I could, but AMX referred my balance to collections.
Then, I started getting calls from Zwicker & Associates. I spoke to one of their reps and was told, if I couldn't work out a payment option they would file a judgment through the VA circuit courts. I explained my circumstances and I told them I would pay as much as I could until I gained employment. Zwicker went ahead and filed a judgment with the Circuit Court in VA and now have a court date.
I'm seriously considering bankruptcy, but am unsure what to do with this judgment from Zwicker...
Any suggestions or guidance would be greatly appreciated.
