Hi ameliapwilliams
Welcome to the forums. You don't have to worry about this because they are just trying to scare you by saying anything so that you start paying them hurriedly.
Their has not been a single case till now that a person has been sent to jail because he has not paid his debt. Even if you wish to pay them, your money will not get deposited in their account because they have been restricted from collecting the debt.
To stop further calls, you can send a letter to them stating that you are not interested in communicating with them otherwise it will be a violation of the fdcpa law and you won't hesitate in taking the matter to the court.
If they keep calling you, you can record their telephonic conversations and inform them that you will be presenting the tape to your lawyer and file a class action lawsuit against them.
You can also lodge your complaints at the District Attorney Office and FTC and request them to take immediate actions.

Ellis Crosby and Associates
Hi Roxette, thanks for the information and the quick response.
Just to make sure - they can't charge me with bad check writing when I did everything online, can they? Can they charge me for anything at all? They said something about it being the "modern day" online check writing fraud. I mean, it makes no sense. They mentioned GTO Collections too. Do you know who they are?
Who do I pay? Do I wait till the 90 days is up and be ready to pay then? I should only owe $510 ($300+90+90+30), not $1000...do you know if I have to pay all of that?
Thanks again.
Hi ameliapwilliams There is a process called debt validation
Hi ameliapwilliams
There is a process called debt validation which restricts the debt collectors from misrepresentating the accounts of the consumers. For a detailed knowledge about it, please read this page:
http://www.debtconsolidationcare.com/validation.html
You will enter into a payment plan only if they can provide you the following information of your accounts.
- The details of the account.
- All the calculation should be shown of the amount that is owed.
- Any copies of the papers to be furnished that shows the payment agreement.
- Provide a verification or copy of any judgment if applicable
- The original creditor needs to be identified.
- The Statute of Limitation needs to be proven for the collection of the debt.
- The license of the collection agency applicable in the state is to be furnished along with the license numbers and Registered Agent
- Proof of the agreement that the debt collector has purchased the debt or has been hired by the creditor to collect the debt from the debtor as this is the basic contract law.
- Complete payment history showing the details of the creditors, payment history, amount of the debt, break up of fees/interest should be provided in paper.
- A copy of the original signed loan agreement between the debtor and the original creditor establishing the debt between both the parties also has to be produced.
If they are unable to provide you the necessary information, it means they were tampering with your account information and you can file a case against them.
Now, to get sure of whom to pay your debt, you can pull your latest credit report from the three bureaus which will be specifying you information of the particular account. You will be paying to those only who are claiming in your credit report. Not to those who allegedly claim your debt.
Since Ellis Crosby is involved in fierce actions, it is possible that they will try to extract money from you in the most illegal way. But, you be rest assured that you are aware of your consumer rights as per the fdcpa laws and exercise them legitimately.
You can acquire more knowledge of your consumer rights after reading this page:
http://www.ftc.gov/os/statutes/fdcpa/fdcpact.htm
If you have any query in between, do let me know. I will be there to assist you further.
Take good care of yourself and have a nice time

I received a harassing phone call from Ellis Crosby yesterday and my work. They said a lot of things...the bottome line is that I had to pay $560 before 6 pm or they would have me arrested and my hard drive from my office subpeonaed. Not knowing anything about them I did monegram them the money. My question...since they are under suspension...what happened to my money? Is the payday company considered paid in full?
ELLIS AND CROSBY
well i sent them money too, and never got a recepit. I called and asked for one, and they still do not give me one. They are liars. And i dont know about you all but i dont give money to liars. Especially ones that threaten me!
Re: Ellis Crosby and Associates
Hi. I read with interest your response regarding Ellis crosby and associates. They called me about a month ago threatening me that If I didnot make a payment on some payday loans they would arrest me - call the state attorney's office. Meanwhile as the guy is talking to me he keeps hangning up the phone -as If to say to me that I am not answering him fast enough. A week later another person calls me and tells me that the guy was wrong in telling me I could do payments and that he will be fired! She then tells me I need to make payments every week. I just made a payment and I am not sure If I should do more? I told the woman I was talking to that I knew all about them and she better not threaten me anymore. I even told her I got a lawyer. To which she replied- then have them contact us and that she will refund the money I have paid them.
Ellis and Crosby Associates are the criminals not a debtor
I received a E payday loan and it would renew every ten days, and they would not email or phone me back to make complete payment contact info was non existent on their site. Well, now Ellis and Crosby call and threaten me with fraud charges, which is really ironic. I'm so glad i found this site, since i did not believe the associate was a lawyer and i committed fraud. My advice anything they say ask them to send the exact same thing in writing, and presto you will never get that document. Why? Because they are breaking the law. contact the FTC. There is no debtor prison.
gertie19047 - You do not need to make further payments to Ellis
gertie19047 - You do not need to make further payments to Ellis otherwise your money will go in waste.
If you browse this forum extensively, you will have stronger ideas to deal with such illegal companies violating the fdcpa laws.
Ellis Crosby
I just received a call from Patrick O'Neil, from Ellis Crosby, threatening pretty much what it appears they threatened basically the same stuff they seem to threaten everyone with. Of course, when I was on the phone with him, I'd never heard of them, or knew of their history, until I "googled" them! He even went so far as to threaten that he could sieze my company computer, since I'd used it in the "commission of defrauding a national institution". I'm relieved, non the less, to have read these other posts... I'm working with a debt management company, so I'll give this info to them, but the man wouldn't even tell me what company I'd gotten the loan through...
Ellis Crosby
One quick question, if anyone knows... I'm in Michigan, not in Florida, do the legal actions, against this company, affect their business in every state?
If the business in Florida is shut down, then I don't think they
If the business in Florida is shut down, then I don't think they will be able to operate outside also.
If they are still threatening in the same fashion as they did earlier, it might be because of the fact that many of us are still not aware about their termination. As a result, they are becoming scared and getting intimidated. We can get the latest news from the state attorney general office in Florida.

I too was contacted by Ellis Crosby today. Scared the crap outta me to be honest. At First, however after calling the Better business bureau the FTC and the Florida Attorney General. These guys too threatened me. Had me thinking they were a law firm. They wre rude and called me at work demanding to talk to my supervisor. They told me they had law suits against me, they were gonna arrest me, and file fraud charges against me and I had to pay $650 RIGHT NOW or else. Then told me Good Luck as I hung up. What the hell was that??? So I did some reserach on the puter and made some phone calls. Turns out these people are in big trouble. YOu can go to the attorney genereals website for california with a search engine. He has apparently filed suit and they are suspended from praticing. I spoke with the secretary today and he is supposed to call me directly Tuesday. What they are doing is illegal....DO NOT PAY THEM ANYTHING. Most people that have paid are still being told they never paid. gGo tot he Better business bureau and the FTG.gov and file complaints. These jerks need to not be doing business. They have had 104 complaints already this year and that was just to the BBB. Good Luck all!! Dottie
Ellis Crosby
i also found out that they have moved, changed address and phone numbers. What a bunch of crooks!

I had the same thing happen with Ellis Crosby and Assc. a few months ago. They called me on my job, scared me and threatened me so I sent them $660 of the $1000 they said I owed. Never heard from them again. They just called my house asking for the rest and since I had already researched them here...I told the lady to shove it. The loan was only for $250 so there's no way I am paying anyone anymore than what I already did.
Also - I received a call last week from "CMS" (it was a 972 area code) which was a collections company. The guy on the other end of the phone made the same threats and I wouldn't answer him straight. He got mad and cussed me and hung up. I am betting that company is very similar to Ellis, Crosby and Assc.

Ellis Crosby is actually the person name. His middle name anyways. Ted Ellis Crosby.
I would recommend checking your credit to see if that is still on there. If you've paid $660 on the $250 loan, then it should have been taken off.
Hate to inform you guys, but no Ellis must not know they are out
Hate to inform you guys, but no Ellis must not know they are out of commission. My mother lives in Texas and they have attempted to collect debt on a loan that was already paid in full.
They try the scare tactic, threaten to throw you in jail for commiting fraud. They refuse to send written documentation, but sware they have proof via phone recorded messages.
Oh, now they are at least admitting that no they are not debt collectors and no they are not attorneys, only attempting to collect on behalf of their client. When you call their client, original lender, they say all our information has been turned over to the third party collector....call them.
This is a no win situation however you turn. In this insidence my mother has documentation that the loan was paid, yet they continued to deduct service fees from her account monthly without her approval (she was unaware they were doing this). When she decided to change banks, to one closer to her home, is when she started to receive threatening calls from Ellis. Getting ready to sick Texas's AG on them. Go get em guys.
Phone records
ANN- Also inform them that they dont tell you they are recording the calls, one guy called me yesterday about a loan and i caught him clicking me in on a recorder and he did not say that he was recording me. Thats Illegal as well
Ellis Crosby
Has anyone been contacted by Elin Collect Edge? I received four calls from them, within two hours, on Saturday morning. They claim that they've taken over all files from Ellis Crosby. I explained that I'm working with a debt management company and told them to send me a written statement of what they claim I owe, how the original PayDay Loan company was, along with the address, phone and fax numbers for themselves and the payday loan company. Of course, I've not received that info... Are they held to the same legal standards as US companies, if they are located in India? Just curious as that's where they stated they were located.
Ellis, Crosby, and Associates
I thought I had heard the last of them when I told them to stop calling me at work and home and not to contact anyone at my work. But guess what. Last Thursday Kate Alexander called me and left a message without saying who the business was. When I called back and ask for her, they said "Oh you want the attorney general's line." She came on the line a proceed to tell the same old stuff about involving my employer since I had used a work computer to apply for the loan. I told her I had filed a complaint with the real Floriday Attorney General's office and told them to stop calling. She was yelling at me and said I had involved my employer by using my work computer and she didn't care if I had filed a complaint. I hung up. She then contacted the IT department at my workplace and ask the department head who with the company was the official "receiver" of legal documents. He then tried to forwarded her to the owner's assitant. Luckly he sent her to the wrong extension and she ended up forwarded back to me. She was mad that she had gotten me when she was trying to call the owner. I contacted my human resources department and explained the problem. He instructed the operator to forward all calls from them to his extension. What a nightmare!!!! I am working with BHR & Associates to payoff the loans. My rep. called them and ask for a manager, who the rep said was polite and willing to work out a payment plan. I told the rep about the warnings about paying them, so he contacted the original debtors and they said they had no problems with Ellis, Crosby, and Associates. So now what?
Ellis, Crosby, and Associates
When I ask for Kate Alexander, the women who answered the phone said "Oh you want the attroney general's line." Since they don't answer with the name of the business, I though it might be the FL Attorney General's office unti Ms. Alexander began to speak to me. She was the worst person I have ever dealt with!!!! Rude, Rude, Rude. I am really confused whether I should pay them or not since the original debtors say you have to deal with Ellis
Ellis Crosby
I'm so confused as neither Ellis Crosby or Elin Collect Edge will tell me who the original debtor is! They keep rattling off "BMG Consulting" and "Premier". I've filed a complaint with the Florida Attorney General, BBB and have sent a Cease & Desist, but what are my options if they continue to call? If they talk to my IT department, I'll likely be terminated... Oh, how I wish I'd never heard of pay day loans...sigh!

Reen you are the one who answers the calls?
if not just tell the IT department to screen all the calls for the IT depoartment, tell them they are not avaiable for those kinds of calls.
what is your position at your work
Ellis Crosby
Hi, Katie... I do answer the calls within my own office, so I've been able to handle most of those, although they've gotten to may manager a few times. Unfortunately, I work in a sales office, for a very large corporation, not in the headquarters. Our IT department is about 100 people, which I, obviously, don't really want to explain all of this too... I'm at my whits end...

Their calls, along with calls from PayDay loans have reached my boss and HR and payroll...
Much to the confusion of my bosses and co-workers. I explained that it was along the lines of identity theft and that I was VERY sorry. They'll understand...just explain that it's really not your fault.
Ellis Crosby
I've taken messages, also, Katie, when I answer the calls, but typically they insist on holding, after I tell them I'm on the other line, and call back, over and over again... I'm affraid to leave the phone, as they're always calling... If I do take a message, for myself, I do call them back, but that doesn't seem to help at all. Just got my third call, this morning, form Elin Collect Edge, on my work number, when I've told them, dozens of times, to call my cell phone. I know they're located in India and my threat, this past call, of telling them I will be calling the FCC to report them for harassment doesn't seem to intimidate them at all... If they are in India, are they held to US and state laws, does anyone know?
Statute of Limitations
Hello,
Just a general question....does anyone know what the statute of limitations is on collecting on a payday loan? I appreciate your help, just curious.

Their favorite method seems to be just plain harassment. :-/

Ellis, Crosby has left me yet another message. I am confused why do they keep saying for me or my attorney to call them back and they left a number. Why do they want an attorney to contact them if they are a collection agency?
Ellis, Crosby, and Associates
They do that to everyone. It makes them sound like some type of legal authority, so you will be more likely to pay if you think you will be arrested for not paying. It is just a scare tactic. But they are well trained at being scary!!!!!!!

Thanks! She called me here at work but I just left her on hold and she hung up after about 30secs. I wasnt able to go off on her like I wanted to. This website has been such a blessing to me!

I talked to Summer. She can't advise me on whether to make the payments. She said I would need to contact an attorney for that question. She also requested that I forward the recent contact information, which will be included in my complaint against Ellis, Crosby, & Ass with the FL Attorney General's office.

Hi Kathryn
Please wait for some time till your debt is sold to some legitimate company as Ellis Crosby is legally found offensive.
I fear that if you pay to Ellis Crosby, your money might not go to your debt account.

Ellis Crosby, and Associates
The BHR representative got a settlement offer from them, but I am concerned about pay it to them. He said that Ellis will provide him a settlement letter with a lists the debts and the settlement amounts to be paid. The rep said this would be my documentation of payment of the debts. He had contacted the debtors and they said they had no problem with Ellis, even after he explained their legal problems. So he believes that it is the debtors problem if Ellis does not pay them since they hired them. I have a couple of weeks to think about it. I know I won't pay without the settlement letter, but it is still very confusing.

Help
I've been reading all of the posts here about this Crosby Ellis outfit. They called me yesterday at work after I faxed them a paper telling them to contact me only via mail. The woman's name was Jennifer Lovitt - she was rude - at one point telling me to shut my mouth. She told me that I wouldn't receive any more calls at work because they were taking legal action. She told me that she was going to call my work and tell them that I was using the company's equipment to defraud a bank. What am I supposed to do now? Do I contact them? Do I ignore it? Help!

They called me yesterday using the name Ellis Crosby and GTO Collections, and said that if I did not Money Gram them $1070.00 by 10 am this morning they were going to have me arrested. They were extremely rude and they tag teamed between two different men on the phone. I thankfully found this site and I looked up the case against them in Florida and I called the Attorney General's Office and filed a complaint against them they told me not to pay them anything.I am so glad I found this site and did my research on them before paying anything.
