Debts from the UK


I am not sure if you can help me or not as I live in Australia. But I am finding this site very helpful.

I live the UK for 2 years and have been back in Australia for 2 1/2 years. Today we received a letter saying that we have a debt over there. I was wondering what can happen to us for having debts in another country. I am just coming up to 9mth pregnant and at the moment I dont want the this stress and so I have asked my husband if we can disgregard this until after the baby comes, but I am very worried that they will get really heavy with us.

Any help would be great. :)

This site exclusive provides services to US citizens. But we provide advice to every one. You have lived in UK for 2 years and after that you returned back to Australia. Now the debts which you have incurred in UK cannot be pursued in Australia. This is because legally it is not possible for the UK collection agency to pursue the debt in Australia. So please do not stress yourself out.

Thank you for that Peter. I do want to pay for this debt, but at the moment I really dont want to deal with the stress. So even though I have received the letter, legally they cant do anything here? I am aware that they can take the matter to court over there without me being there, but getting the letter is that more bark than bite?

Kellie, don't think about your debt so much right now. You need to take some rest during this time. The collection agency cannot come to you in Australia to collect the debt from you.

If after some time, you return to the UK, there might be a judgment against you and you will have to pay the debt at that time. But for the time being, there is nothing to do from your side right now.

Also, if the debt goes crosses the SOL period, then you will not be required to pay this debt. The collection agency cannot enforce you to pay the said debt if the statutes for legally collecting the debt are over.

So, right now, have a very comfortable and peaceful life in Australia and think that you will be able to make arrangements regarding your debts when you return back to the UK.
