Who sent this collection notice? Did you check if the information posted there is correct? If the file is not sold by MBNA, you can do payments to them directly.
The debt is valid and you will need to arrange a payment plan with the credit company.
Do you remember the last payment on the account? You will come to know if the debt is within the SOL period.

payments can't be made all her money goes to the nursing home. I was told by MBNA that they would just close her account out and this was in 2004 and nothing else would have to be made on it. I was just making payments to help out and can no longer do this. the company I got a letter from is Pallino Receivables III,LLC and you can't call them there is no number.

the company that sent my mother the collection notice is just a drop off point for this Pallino place and they send these collections to the people. they have no way of communicating with this company. It just has the criedtor name Pallino my mothers name, account#, amount and original creditor names MBNA

The company that is collecting for Pallino Receivables III must validate the debt because they are doing the collections for the CA. They are also obligated to follow the same federal laws.

Welcome to the Community phurley :D Since all your mothers' money has to go to the nursing home, I would write them a letter(keep a copy) and tell them of previous contact where they said it was settled. Tell them all her money goes to nursing home, nothing else. Whatever they send, or whoever you talk to, keep records and send them certified, return receipt, so you can show they signed for it and that you are trying to get this settled. If you have any questions, please ask!..KAren By the way- if they mark this settled or whatever they do,get it in writing!

Since the debt is only in your mother's name, they can't do anything to you personally. Your mother is in a nursing home, so realistically speaking, she is very judgment proof. The funds that go directly to her nursing home are most likely 100% exempt, such as Social Security or some form of Medicaid or Medicare, so they can't seize those funds. If they even tried to do that, they would be liable for wrongful levy or execution on exempt funds and would end up owing her money. Think of how a judge would look at this situation? Those attorneys who even tried such a thing would be in some hot water. All they are doing now to you is trying to scare and threaten you into paying them money. If I was you, I wouldn't pay them or the original creditor even one more penny of money. I would let them know in a letter sent by certified mail that your mother is an indigent invalid residing in a nursing home and therefore cannot afford to pay any of her bills. They will get the message that they aren't going to get any money out of you, and move on to someone who can pay.

I got a phone call yesterday from my mother, saying that somebody called my grandmother (2000 miles away from where we live) to try to find my husband and I. How they found my name and then my family's names I don't know, as they were looking for my husband. I called this guy back, and he said he works for a company which is contracted by Pallino to collect debts. They said that Pallino bought a debt from the credit card company, a debt which was from 10 years ago, and now my husband owes Pallino over $6,000. But, if we wanted, we could settle right now, and give them our credit card number and they would charge us $2,500. How convenient for them that I could just give them my credit card number. I told the guy that it is not on my husband's credit report, and he went on to say that it isn't yet, but if we don't pay this bill, they will put it on his credit. This is a fraudulent company. Check out the internet, they don't have a legitimate address or phone number, and when you question them, they start to harrass. Don't pay them anything, and if they keep harrassing you, tell them to start sending the information to your attorney.
