Need advice Bass & Assoc - IMPORTANT

I just rec'd a call from this company, which only showed the number on the caller ID, from a Suzanne Thompson. She was rude, stated that this was a legal matter that either Mr. XXXX (my cousin) call her or his representative atty. She expected a returned phone call shortly or the police would be involved.

So I contacted my cousin & he decided to have his wife call them to get info. This Suzanne Thompson claims that my cousin took out a payday loan online & that he now has 3 affadavits that are being sent with charges of - theft by fraud, wire transfer fraud, FCC internet fraud, etc.... She claims that his email address involved is a fraudulent email address that now involves the FCC & other federal agencies. That since his bank account was closed, he committed offenses there since he was supposed to have it remain open. She was explained that his bank acct had become compromised with unauth'd withdrawals in excess of $650, so the bank placed a hard hold on all funds until they can investigate what happened. She actually called him a liar & told him that she has proof that the bank closed acct for NSF reasons. He knows that her claims are untrue.

Then she demanded payment of %535 for original loan, fees, atty fees, collection fees, etc... that the funds have to be sent to her office within the next 2 hours. He simply told her, what of the bank has all funds on hold do you not understand! She then said that he are refusing to pay this loan? Well, I guess that you want to go to jail & I will be faxing a request for warrant for your arrest & XXXX police dept will be arresting you within 3 hours.

Can she have my cousin arrested for not paying a payday loan?

NO WAY, your cousin will not be arrested. Somebody needs to go arrest her for telling you all this garbage. They are just a collection agency who is notorious for calling and harrassing people. They use all that talk just to try and scare people into paying them money. It is very very illegal for them to threaten you with arrest. I recieved several calls from them myself.

Don't be tensed. Just do a google search on Bass and Associates and see endless postings on this company. Every person dealing with Bass & Associates is complaining the same thing like you mention in the post.

Tell your cousin not to be tensed. B&A is doing illegal business. Record the phone calls if it's permitted in your state secretly. You can take them to the court for violating the federal and state laws. Read the FDCPA and get informed of your legal rights.

Throw a debt validation letter to their mailing address and let them confirm their business is legitimate.

Check out this link if you haven't done so already.

Several people on this site have been contacted by this company. A collection company is also supposed to send you debt validation when you request it within 5 days of asking for it. Nobody has been successful in getting their debt validated with this company.
