How should my daughter deal with a judgement


My daughter owns a car and her bf took it without her permission. Come to find out, she had no insurance on it and he totaled it. She kept paying on the loan as long as she could but now can no longer pay. Her bf is in rehab and she is a single mother of 3 kids working only part time. The loan company has gotten a judgement against her for the balance of the car. If she files bankruptcy, will the debt be resolved?


worried mom I dont think so. Cars are not allowed in bankruptcy. I dont think they can be discharged. They are secured debts. You can keep them or loose them the way I understand it. If you want to keep them you have to file reaffirmation. KYSIDE38

I am about to finish my chpt 13 in a couple of months, I had included my car and got to keep it. It was actually paid off early May this year. She will be put on a payment plan that fits her budget but she will need to tighten her purse strings and follow a budget. Her judgment will be included in the plan. I know that many people have different views on bankruptcy but I have to say in my case it was the best thing I could've done. I wasn't behind in my house or car payments but my son had over $200,000 in medical bills and I was paying out over $500 month for both of my boys meds, things were not looking good. And I believe you can recover after bankruptcy. Now I am getting help with my children's prescriptions through a waiver program for the disabled and my income doesn't count against me. I had a good experience with my chpt. 13 but I understand everybody's case is different. I just wanted to share one person's experience going through this.

It's a matter to be taken seriously because the judgment is already hanging over the head. Either a payment plan has to be arranged with the loan company. If they win the case, there are chances that a wage garnishment will be done on your daughter after analyzing her income.

And if your daughter fixes a payment plan under bankruptcy, she will be allowed some time to pay off the loan. So, she has to make a choice for the best option.

another ? is what state does ur daughter live in/ that has alot to do with what they can do with a judgment also..if in pa, carolinas, or texas they cannot garnish for debt except taxes alimony child support or rent..also does she any assets that can bet aken for this judgment( some things are exempt shed have to look at her state laws for that).. now as for bankruptcy she needs to look at things like other debts that she will also include in bankruptcy..if this is the only one it may not be worth her to file..its very scary i know im goin throught teh same thing right now.. tell her i wish her the best and shes not alone..

Chapter 13 is definitely an option..It would help her make payments on all of her debts, and get things under control. A good consolidation plan can also help stop judgements as well... Why don't you register with the site? A counselor will call you, and they can help you with this situation.

To the lady with the 200,000 medical bills who is just finishing her chapt 13....

in your budget plan, did they give you any kind of expense for yourself like extra money for entertainment or living expenses that would be considered a little extra? In other words....what happens if you need alittle bit of money for something? ...I'm just starting the chap 13...meaning, they are just now working up the budget and my husband said it will be so tight we won't be able to break wind! this has me terrified because if something should happen where would the money come from.
