take money out of my social security
I filed bankruptcy in 2000 and stated working in va in 2001 and was trying to pay all my bills on time. In 2005 i had a heart attack and unable to work. My social starting last month . A credit card company has sued me for 5,000 dollars. Will this affect my social security or can they take it out of my social check each month or other retirement funds i do not own any vehicles or house. Thanks

Up until 2004 sec 207 of the social security act said that SS could not be garnished except for child support or taxes. Now certain debts can be garnished from SS, up to 15%. credit card debt is NOT one of them. As far as your retirement, what types of plans do you have?
Have you had any sort of hearing on this? Your best bet would be attempt to make payment arrangements right away.
