Terri Loan - Filed w/ Court


I have a Terri Loan from 1998 - I just received a notice of a petition to the court for jusdgement - no court date. Is there any help for me at this point? We live at/below the poverty line, my husband is disabled with Parkinson's and needs 24 hr. care. Our only source of income is his Soc. Sec. Disability. I have a not yet 2 year old son. I WANT to take a job - I've always worked hard, but there is no way I would net any money between the cost of care for my husband and son. I feel so stuck. We have an inexpensive house with no equity - it took all we had to get it, and most of our money goes to paying for it. The rest to clothes, medical and our luxury is the internet (no cable etc...). I also have Direct Loans, but will contact them directly. I filed Bakruptcy in 2003, but of course the loans weren't discharged. Without any ability to pay is there any help? I tired explaining our situation to the collectors, but I know I need to do more. Thanks in advance.


Welcome! I'm sorry to hear about your troubles,but you are not alone :D You need to reply to the petition,if it's what I think it is,within so many days. Failure to due so,grants them a judgement. In many cases,you can file a hardship with the court,check into this with the court clerks' office. Since you signed up for the forum,someone will be contacting you soon about your free credit counseling. You said there is no court date in the petition, right?? I think you should visit your local county office and inquire about this petition. I don't know if the papers have been filed properly. You will get this info confirmed with the clerk. A legal judgment is reported in the latest copy of the credit report also.

Thanks so much for your response. It's actually even worse than I thought. I just received a letter of jusgement. Now I am really at a loss for what to do. I'm scared we'll lose our home or our only vehicle needed to get my husband his medical care. I have no idea how we will pay for this, but is there anyway to relieve a judgement or consolidate it or anything? Look forward to responses, and I'll be doing some research. Tess

Hi Keystrokes,

When I was served, I didn't even know what it was that I was receiveng. For a million legitimate reasons I just didn't understand the paperwork, and missed the deadlines. We spent the summer with my father, and I just got the mail which contained a letter of judgement. Now I'm really worried. Is there still any help out there? Thanks for your reply! Tess

Tess, some states offer free legal advice. You should look out for such assistance offered in your area and decide your next moves. Remember, the judgment is already there against you and the SOL will remain active for a long time. So, defaulting on the payments won't be good for you at this stage. Look for some debt consolidation companies in your area whether they offer any help for people in judgments.
