Tax return after BK

You are fine...my BK was discharged in a september and we got ours fine.

What about with a chap 13? I thought I saw some where on these boards that you could keep up to $1500, then they could take any amount over that at the discretion of the trustee??? I can't seem to find it again.

the way my lawyer explained it for a 13 is ANY disposable income becomes property of the trustee to pay back your debt and you would not receive any of your return. With a 13 they decide how much of your money you need to survive and everything over that goes to pay your debt, you don't get to keep any extra money at all including your tax return.

I'm not sure I agree with the last post because my husband got to keep his entire return and is in chap 13. The trustee requested a copy of his return, which I think he got back about $1200. It could be different in other areas. We are in Indiana.
