Hey everyone. My wife and I are going to see a lawyer about possibly filing for bankruptcy. In the mean time, what do I tell the creditors and banks when they call. Also, if we do file for bankruptcy, will the calls continue or does our lawyer contact them to stop. Thanks, Ed.

The bankruptcy trustee and your attorney will make sure that your creditors are served. The phone calls are supposed to stop. If not, contact your attorney and he will handle it from there. Creditors can be fined if they continue to try and collect on a debt that is included in a bankruptcy.

until you actually retain an attorney there isn't much you can do to stop them from calling. Once you have retained an attorney, if anyone calls you just tell them you have retained an attorney and give them his or her phone number.
